necessary to meet the emergency created by the snowstorm of January 29 and 30 for the removal of snow from t he city streets and was also instructed to work_ three shifts of* drivers on his trucks for the purpose of snow removal. Mr. Yloomaw submitted a report on zoning concerning a lot owned by the 0. A. Clark Estate at the southeast corner of the intersection of U.S. highway 31 North and Peashw.ay which report was ordered placed on file. /Attorne�r 1�1. A. Slick submitted a sketch for driveway openings in front of his property on Lincolnway East. The plain was referred to the Engineering Department for in vestigation and report. 11r. Slick was requested to report to the Board at the next regular meeting. 'Tjr. Qualls submitted a summary of the street 111-ht-.1g costs for the year 1938. A breakdown of this year's sumrlary covers the number of lights in service, the type of illumination, construction and rate of each; also the amount, of surplus funds anticipate at the close of this fiscal year. /LVIr. Qualls submitted a report on a petition for a street light at the intersection of Elwood and Johnson Streets and Hr. Qualls' recommendation is that there is a light now at the middle of the block between Elwood and Humboldt on Johnson and at the inter section of Broomfield and Elwood and O'Brien and Elwood and that the; petition for in- stallation of this light be rejected. Based upon the recor:ffnendation Q-f- Mr. Qualls, the Board rejected the petition for a light at the intersection of Elwood. and Johnson. A petition for re -allot ment of assessments on Improvement Assessment #2154--Fair- view Avenue Local Sewer was considered by the Board. "The Board has sought the opinion_ of the City Attorney in this matter and it is his opinion that in view of the fact that the p-roperty was not platted when the assessments were 1Made, that the enti be assess_nent is a lien a-ainst the entire property- and cannot, at this time, be allocated to different lots or to individual Y,=ortions of the entire tract and that the only way to clear the property of the lien is to pay the entire assessment. "If you can furnish us any law to the contrary which will satisfy the City Attorney that his opinion is not correct, vie will be glad to re -consider it.
