M. All members were present.
This being the date set, hearing was had on the Assessment Roll showing awards and
damages and the assessment of benefits in the matter of vacation of Cherry Street from
the north to the south line of the New York Central right-of-way, same being Vacation
Resolution #2478.
In the above named Assessment Roll no remonstrators appeared and no written
remonstrances were filed. The Clerk of the Board submitted proofs of delivery of
notices and same were found to be sufficient.
A letter from the Malleable Steel Range Manufacturing Company setting forth the
fact that it was their understanding when Cherry Street was closed at the elevation
that a passage way for Pedestrians would be provided which was fully considered by the
Board, but the matter of closing Cherry Street, as covered by the above named Vacation
Resolution, being a matter of contract on which was based the elevation project, no
further consideration could be given to such.
The Board, therefore, finds that the several lots and parcels of land, having been
benefitted and damaged in the amounts as shown on said Roll and decides to take final
action on said Assessment Roll and declares same in all things ratified, confirmed and
approved without modification and the proceedings closed and said part of Cherry Street
covered.by the above named Vacation and all proceedings had with reference to said
Vacation are hereby sustained.
This being a special meeting and there being no further business, the Board
adjourned at 10:45 A. M.
ATTEST:— Clerk
•
M
Board of Public Works
