MEETING NOVEMBER 4, 1935
<br />Regular meeting of the Board of Public Works was held on Monday, November 4, 1935
<br />at 10:30 A. M. All members were present.
<br />Claims, from the following suppliers, in the amount of $662.57 were approved and
<br />ordered paid.

<br />Mr. J. C. Weer, Street Commissioner, submitted his report of the work done by the
<br />Street and Sewer Departments during the month of October, which was ordered placed on
<br />I file.
<br />Fire Insurance Policy in the Farmers Conservative Mutual Insurance Company, South
<br />Bend, Indiana, covering loss by fire on the Street Department new garages, was approved
<br />and ordered placed on file.
<br />A communication from the New York Central Railroad Company, also from the Grand
<br />Trunk System, in response to request of the Board that they repair the pedestrian
<br />crossings at Walnut Street, Harris Street and Vernon Street, was read and in each case
<br />the Railroad Company advised they would do all in their power to repair and keep in
<br />repair their crossings.
<br />Mr. Weer submitted a report of the work done by the City under the Works Progress
<br />Administration during the month of September, showing the cost to the Street Department.
<br />This report was placed on file.
<br />Yz . William Longenecker, Sexton, submitted his report of the work done and receipts
<br />for the month of October, showing that he collected for services rendered $371.00.
<br />A communication accompanied by blue print from the South Bend Lathe Works was
<br />presented by their representative, showing the construction of a new entrance to their
<br />general office. Copy of their request follows:
<br />"We are planning the construction of a new entrance to our general office, and
<br />have had plans drawn and a building permit issued on the assumption that the buildings
<br />- on the property adjoining ours to the east and west do not extend beyond the street
<br />line.
<br />Upon having the line surveyed, however, we find this is not the case and that our
<br />entrance if constructed in line with the buildings to the east and west, will extend
<br />beyond the street line a distance of approximately thirteen inches.
<br />The street is quite wide at this point, the sidewalks are ample and the berm is
<br />wider than usual. Also the front line of our entrance, as we propose to construct it,
<br />would still be three feet back from the sidewalk.
<br />In view of these facts and the further fact that our space inside the building at
<br />this point is limited and the working out of the arrangement we have in mind would not
<br />be possible on any other basis, we respectfully request that we be permitted to construe
<br />this entrance according to our original plans, with the understanding, of course, that
<br />if at any time it should become necessary to widen the street in such a manner as to
<br />interfere with the entrance, it will at that time be removed.
<br />The entrance we propose to construct will be approximately fifteen feet wide, and
<br />as we said before, will extend beyond the property line a distance of about thirteen
<br />inches.
<br />We enclose a plat showing the location of all buildings involved and the point at
<br />which we propose to construct our new entrance, and respectfully request that your
<br />permission be given to proceed as outlined."
<br />A communication from the New Jersey, Indiana & Illinois Railroad Company remon-
<br />strating against the closing of Cherry Street was read. The Secretary replied to this
<br />letter setting forth the fact that hearing on November llth is on the final roll of
<br />benefits and damages and not on a Resolution vacating the street.
<br />This being the date set hearing was had on the assessment roll showing the award
<br />of damages and the assessment of benefits in the matter of vacation of alley south of
<br />Almond Court from alley east of St. Peter Street to alley west of Notre Dame Avenue,
<br />same being Vacation. Resolution No. 2484.
<br />In the above named assessment roll no remonstrators appeared and no written
<br />remonstrances were filed, the Clerk of the Board submitted proofs of delivery of
<br />notices and same were found sufficient, and the Board, therefore, finds that the
<br />several lots and parcels of land have been benefited and damaged in the amounts shown
<br />on said roll. The Board, therefore, decides to take final action on said assessment
<br />roll and declares same in all things ratified, confirmed and approved without
<br />modification and the proceedings closed and the alley vacated upon receipt of the
