<br />Development, property located at Parcel A: bounded by Chapin Street, the Norfolk Southern Railroad, Laurel
<br />Street and Western Avenue; Parcel B: bounded by Pine Street, Western Avenue, the first east/west alley north
<br />of Western Avenue, and a line 40 feet west of the east line of Lot 10, Ruckman's Subdivision of Bank Outlet

<br />Dear Council Members:
<br />1 hereby Certify that the above referenced ordinance of City of South Bend Board of Public Works, et al was legally
<br />advertised on Thursday, February 4, 2010 and that the Area Plan Commission at its public hearing on Tuesday,
<br />February 16, 2010 took the following action:
<br />Upon a motion by John DeLee, being seconded by Jack Mell and unanimously carried, with Gerry
<br />Phipps abstaining, the proposed ordinance of City of South Bend Board of Public Works, et al to zone
<br />from GB General Business District, MF2 High Density Multifamily District, and MU Mixed Use
<br />District to PUD Planned Unit Development, property located at Parcel A: bounded by Chapin Street,
<br />the Norfolk Southern Railroad, Laurel Street and Western Avenue; Parcel B: bounded by Pine Street,
<br />Western Avenue, the first east/west alley north of Western Avenue, and a line 40 feet west of the east
<br />line of Lot 10, Ruckman's Subdivision of Bank Outlet 75, City of South Bend is sent to the Common
<br />Council with a favorable recommendation. The development will not only be an asset to the immediate
<br />neighborhood, but to the City of South Bend by increasing the attraction of the area as a recreational and
<br />commercial destination.
<br />The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the
<br />minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report,
