127 <br />MEETING APRIL,29,1935. <br />Regu;ar,meet,ing of the Board of Public Works was held on Monday April29,, 1935 <br />at 11.30.A.M.All members were present. , <br />Chas Cole and Wm Moore Engineers, -Appeared before the Board and brought to its <br />attention,as Mr Cole stated he had several ;devious Boards.that there is no definite <br />plan set up to be followed in which to collect benefits resulting from condemnation <br />proceedings and that there are a good many of them delinquenteAfter some discussion <br />Mr Cole was invited to consult With City attorney Hunter in an effort to find a <br />remedy and make some plans for future procedure. <br />Replying to letter written by city attorney Hunter to G.A . #Farabaugh,attorney <br />for the N.Y.C,R.R.the following letter was received and read to the Board and <br />ordered placed on file, <br />Dear Mr.Hunter: <br />-Receipt is acknowledged of petition of property owners in the 'vicinity <br />of Leer Street -crossing with the New York Central Linestrelative to certain noises <br />claimed to be unnecessary in the operation of New York Central trains across this <br />crossing.I have refered the matter to the general counsel for the New York Central <br />at Chicago. <br />The peculiar thing about this situ6tion is.that every time a suit is' <br />brought against the New York Central for damages,occasioned by collision, between <br />a train"and a automobile or a pedestriantat one of these trossings in the eastern <br />part of South Bendsthe complaint always alleges and proof is attempted to be made <br />that the engineer on the New York Central train involved in the accident did not <br />blow his whistle.and now the property owners complain that there is to much whistle <br />blowing.,This whistle blowing is compelled by an Indiana statutetwhich provdes,as <br />I recallthat the whistle on every train approaching a crossing shall be blown <br />three timesthe first of which blasts's.hall be at least 1300 feet away from the <br />crossing,,' <br />However.as I said beforej will take this matter up with the general <br />counsel in Chicago. <br />Yours Very Truly. <br />G.A*Farabaugh. <br />A petition for the construction of a sewer on Scholum St signed by five.petitioners <br />The matter was refered to -the Engineering Dept for investigation. <br />A proposed contract with the linde Air Products Co of Chicago for supplying oxygen <br />and Acetylene to the various departments of the city of South Bend was discussed <br />land referred to the city Attorney, <br />The -following communcation from the Pennsylvania R-Powas read, <br />Board of Works, <br />South Bend Ind, <br />(Gentleman: <br />On November 11,1930,your Board approved a plan which was submitted <br />providing for the replacement of our present pile and frame bridge No.180.92 <br />1just south of Ewing avenue with 72" reinforced concrete pipe. <br />We no contemplate makeing replacement at this point and would like <br />to use 68"x 74" oval reinforced pipe instead of the 72" pipe as originally <br />intended. <br />Will you please give us your approval to substitute oval pipe for the 721, <br />round pipe.Print showing the approval to which I refer is attached. <br />Yours Truly. <br />F.R.Rex,supt <br />After considering the matter the Board decided not to permit the subititution and <br />instructed the secretary to write`them the following letter. <br />Mr F.R.Rex Supt <br />Penn R.R. <br />Logansport Ind. <br />Dear Sir: <br />Your letter of April 24th was read to the,:Board of Public Works at its <br />ineeting monday April 29.It was decided that substitution requested be not approved <br />'It is pointed out to you in this connection that where Bowman creek crosses So <br />i chigan St the culvert opening is about 75 square feet and that runs full at times <br />0 we do not consider the pipe you suggest as aaquate. <br />Yours Truly <br />Secy. <br />Mr Ernest Kizer representing the Gafill Oil Co appeared before the Board and <br />requested a permit to erect a small building for storing tow bars at LaFayette & <br />3ample Sts.The Board authorized this permit to ex-oire July lst 1935. <br />Plaims in the amount of 2968.80 were allowed also Street Sewer,and cemetery Dept <br />-fay rolls in the amount of 4182.61. <br />Excavation Bond in favor of Anthony KuJawski & Son in the Maryland Casualty Co <br />iof Baltimore was Approved. <br />• Contractors Bond of Oscar A.Heinrich was released at the request of the Fide lity— <br />& Deposit Co of Chicago. <br />---------- <br />The Mee t' 2:10 P.M, ----- ---------- <br />ATTEST --- Clerk <br />------------------------------- -- <br />'Board of Public Works <br />
