Agreement This agreement is entered into between the Board of Public Works of the City of South Bend, Indiana (hereinafter called "Seller") and Jeff Chamberlain (hereinafter called "Buyer") for the sale of a dog registered as Dex (hereinafter Dog). The Buyer was the handler of the dog until 02- 06-18 (hereinafter "Retirement date") when Buyer leaves the South Bend Police Department K- 9 Unit, the parties agree that: 1. The Seller of the dog, which was obtained to be a member of the South Bend Police Canine Unit has been found to be unfit for the purpose for which it was acquired. 2. The Buyer has been made aware of the purpose for which the dog was obtained, that the dog has undergone training and as a part of that training the dog was trained to subdue individuals, with force from biting under certain circumstances, whom may have been in the process of committing crimes, 3. The Buyer, has had' an opportunity to examine the dog for any physical defects as she was the dog's handler for several years and is familiar with, the dog. 4. The Buyer is purchasing the dog "as is". 5. The consideration of the dog is one dollar ($1.00), plus all expenses incurred in connection, with the dog after the retirement date. 6. As further consideration for the purchase of the dog, the Buyer agrees to indemnify and hold the City harmless from any claims, suits or other actions arising out of the actions of the dog after the time the dog is retired andl ownership is turned over to the Buyer. 7. The Buyer is aware of the existence of certain ordinances of the City of South Bend concerning attack dogs and dangerous animals.
