N age i <br />February 7, 2018 <br />SUPPLEMENTARY AMENDMENT #1 <br />TO THE AIA B 101-2017 AGREEMENT BETWEEN OWNER AND ARCHITECT BY AND BETWEEN: <br />CITY OF SOUTH BEND VENUES PARKS & ARTS and <br />GREGORY A. KIL & ASSOCIATES, INC. (d/b/a Kit Architecture/Planning) <br />Agreement Dated July 18, 2017 <br />Article 1.1.1, The Owner's Program for the Project: add the following: <br />"The Sept 21, 2017 Architectural, Structural and MEP Conditions Assessment and updated Schematic <br />Plans dated January 12, 2018 will serve as the Program for the project. Given that the Owner's funding <br />for the project is limited to $1,000,000.00 (one million dollars) for Architectural/Engineering design and <br />Construction Cost, the plan for implementation is to complete prioritized scope that will allow for the <br />primary renovation to occur and to provide ease of future additional scope upgrades where possible, <br />while working within the budget allowed." <br />Article 1.1.3, The Owner's budget for the Cost of the Work, as defined in Section 6.1: add the following: <br />"The Owner's funding for the project is limited to $920,000.00 (nine hundred twenty thousand dollars) for <br />Construction." <br />Article 1.1 A, The Owner's anticipated design and construction milestone dates: Add the following: <br />"Design Development to be completed within 2 months of contract amendment execution <br />Construction Documents to be completed within 1.5 months of approved Design Development Drawings <br />Project to be bid in Spring/Summer of 2018, with Construction to start in early summer of 2018. <br />Construction is expected to require 6 to 8 months to complete." <br />Article 2.5.1 Commercial General Liability, delete and replace with the following: <br />"Commercial General Liability with policy limits of not less than One Million Dollars <br />($1,000,000.00) for each occurrence and Two Million Dollars ($2,000,000.00) in the aggregate for <br />bodily injury and property damage." <br />Article 2.5.2 Automobile Liability, delete and replace with the following: <br />"Automobile Liability covering vehicles owned, and non -owned vehicles used, by the Architect with <br />policy limits of not less than One Million Dollars ($1,000,000.00) per accident for bodily injury, <br />death of any person, and property damage arising out of the ownership, maintenance and use of <br />those motor vehicles, along with any other statutorily required automobile coverage." <br />Article 2.5.5 Employers' Liability, delete and replace with the following: <br />"Employers' Liability with policy limits not less than Five Hundred Thousand Dollars ($500,000.00) <br />each accident, Five Hundred Thousand Dollars ($500,000.00) each employee, and Five Hundred <br />Thousand Dollars ($500,000.00) policy limit." <br />Article 2.5.6 Professional Liability, delete and replace with the following: <br />"Professional Liability covering negligent acts, errors and omissions in the performance of <br />professional services with policy limits of not less than One Million Dollars ($t,000,000.00) per <br />claim and Two Million Dollars ($2,000,000.00) in the aggregate." <br />
