Section 1.1 SAFETY REQU I REM ENTS/V10LATIONS <br />Safety during performance of the work is of paramount concern to the City. Vendor agrees to comply <br />with the provisions of the Occupational Safety and Health Act of 1970 and the standards and <br />regulations issued there under and certifies that all actions furnished under this order will) conform to <br />and comply with said standards and regulations. Supplier furtheragrees to indemnify and hold <br />harmless the City for all damages assessed against the City as a result of Vendors' failure to comply <br />with the Act and standards issued there under. <br />Tyler will comply with all applicable laws, including applicable Occupational Safety and Health Act <br />laws and regulations. Tyler reserves the right to discuss in good faith which laws and <br />policies/procedures the City considers applicable, and to identify those in the contract, Tyler will <br />indemnify and hold harmless the City and its agents, officials, and employees from and against any <br />and all third -party claims, losses, liabilities, damages, costs, and expenses (including reasonable <br />attorney's fees and costs) for Tyler's violation of a law applicable to its performance under the <br />Agreement, subject to the indemnification provisions in Tyler's standard contract. <br />62 <br />City of Soulh Bend, IN <br />U6111y [Whoq SyOcn? <br />
