Salata claims that while 'proceeding west on last Jefferson Blvd., his <br />car hit a hole in the street and caused d emPges enumerated by him. Undoubtedly the <br />drive of a vehicle has s right to proceed along a street at a reasonable rate of speed <br />without having holes therein cause blow -outs and other damages to his automobile. <br />Consequently, if from the facts which you have gathered, it appears that LIr. Salate <br />had his automobile damaged by a defect in the street while proceecing along said street <br />I at a reasonable rate of speed and that the officials of your department responsible <br />for street maintenance either knew of the defect or with reasonable deiligence should <br />1 have knovrn of the defect., then there is no question cf liability. <br />4s to the amount of Mlr. Salatat s dnnTes, the only questionable feature is <br />the two tires. These, Irk understand, were second !,,and tires when he bought them. <br />It may be that you feel that the price set by him fctr such second hand tires is too <br />
