<br />This being the date set, hearing was had on Vacation Resolution No.
<br />2472 for the vacation of the alley situate in a triangular parcel of Arnold's -�,irst
<br />Addition to the City of South Bend., Indiana , vt ich parcel is- bounded on the East by
<br />Grant Street, on the north by Mlerry Avenue: and on the Southerly side by the right -of-
<br />way of the New York Central Railroad. Company
<br />In the above named vacation resolution No.2472 no remonstrators
<br />appeared and, no written remonstrances were filed. A7r. A. H. Huguenard, Attorney for the
<br />Chicago, South Sho-r.e and. South Bend Railroad Company was p.,esent, and the Board adopted
<br />!1 the following Confirmatory Resolution No.2472:

<br />WHEREAS, the Board of Public Works of the City of South bend, County
<br />I, of St. Joseph and State of Ind is na, did on the 31st. , day of May, 1932, adopt a resolu-
<br />tion that it desired and deemed it necessary to vacate the alley running from the west
<br />line of Grant Street to the south line of Merry Avenue in said City of South Bend, more II
<br />particularly described and bounded by a line running as follows:
<br />Beginning at a point which is the southeast corner of Lot Numbered I
<br />Thirty-five (35), as shown on the recorded plat of Arnold's First Addition, which point ;`
<br />is in the west line cf Grant Street; thence running west along the south line of lots
<br />Numbered Thirty-five (35), Thirty-six (316), Thirty-seven (37), Thirty-eight (38) and
<br />Thirty-nine (39), as shown on the recorded. plat of said Arnold's First Addition • thence
<br />running northwesterly along the southerly line of Lots Numbered Thirty-nine (39j, Forty I
<br />(40), Forty-one (41) and Forty-two, as shown on the recorded plat of said Addition, to
<br />the south. line of 1-Terry Avenue; thence west oi. the south line of 11erry Avenue projected
<br />west to the right-of-way of the New York Central Railroad Company; thence southeasterly 1
<br />along the northerly line of said right-of-way to the north line of Lot Numbered r'orty-three
<br />(43) as shown on the recorded plat of said Addition; thence east along the north line
<br />of said Lot Numbered -0orty-three (43) to the west line of Grant Street; thence north
<br />along the west line of Grant Street to the place of beginning; and i
<br />WHEREAS, said Board of Public Works of the City of South Benddid, in
<br />said resolution, fix the 21st. , day of Dune , 1932, at 10 o'clock A. 111 , as the date at
<br />which said Board will receive and hear remonstrances from persons interested in or
<br />affected by said proposed bacation and vrould take final action thereon; and j
<br />WHEREAS, said Board of Public Works of the City of South Bend, Indiana
<br />did give notice of such resolution -and of the time when said Board of Public V�orks would
<br />receive and hear said remonstrances by publication of said notice once each week for
<br />two (2) consecutive weeks in the South Bend 'tribune and South Bend. News Times, two
<br />daily newspapers of peneral circulation published in the English language in the City of
<br />South Bend, Indiana, the date of said publication being on the 3rd ., day of June , , 1932,
<br />and. the loth. , day of June, 1932; and
<br />NHE'REAS, owing to a failure of a majority -pf the members to be present
<br />t the meeting of this Board of Public Works on the 21st. , day of June, 1932, at 10
<br />'clock A. y% final action in this matter was continued until the 28th., day of -June,
<br />932 , at 10 o; clock A .Ij ,and
<br />WHEREAS, pursuant to said notice, this Board of Public Works of the
<br />ity of South Bend, Indiana , did meet on the 28th. , day of June , 1932, at 10' o' clock
<br />M. of said day for the purpose of receiving, hearing and consid eeing remonstrantles
<br />rom persons interested in or affected by the proposed vacation of the alley described
<br />bove and to take final action conf firming, modifying ar rescinding the original resolu-
<br />ion for said proposed vaceti on adopted by said. Bom rd of Public 6ork s on the 31st. , day
<br />f Iday, 1932; and
<br />WHEREAS, no remonstrancces have been made or filed with or presented
<br />the Board of Public Works against said proposed vacation, the Board now proceeds to
<br />a.r the same and being fully advised in the premises and having fully considered the
<br />tter of said vacation, said Board now takes final action on said resolution, confirm-
<br />g, without modification, all former action taken on the same;
<br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the
<br />ity of South Bend, Ind iana., that said Board now in all respects confirms its said oripi
<br />al resolution adopted on the 31st. , day cf May, 1932, vacating the alley hereinabove
<br />escribed and orders H. C. Wray, Uity Engineer, to prepare a list or roll of all owners
<br />r holders of property and all interess therein to be beneficially or injuriously affect-
<br />d by said vacation, which said list or roll shall show with reasonable certainty, in
<br />ddition to the names of the holders or oviners of said property or interest therein,
<br />he description of each piece of property belonging to each person to be affected, either
<br />eneficially or injuriously, which list csr roll shall be filed with the Board of Public
<br />or ks of the City of `'out h Bend, Indiana; and
