H . G. dray ,
City Engineer.,
(! C ity of South Bend, Indiana.
i
i Dear Sir:
Your letter cf the 28th., ultimo stating that the Board of Works is in
receipt of a petition signed by prop erty owners on Portage Avenue, requesting the
improvement of that street and the removal of street car tracks, has been referred
to the u nd. er si gned .
This company is in the hands of the court, and as the Receiver appointed
• by the Judge of the court having jurisdiction, I am simply an official of the court.
IAs the Receiver, I cannot predict the attitude of the Court in this matter.
Before I feel like taking this matter up with the court, I would like to
gibe informed as to the probability of the improvement being remonstrated out. Con-
I sidering the present depressed condition of business, it would appear possible that
a petition calling for such a large expenditure of the tax p ayer, s money for an im-
jpront that is not vitally necessary, would not stand a very good dance of being
approved by the necessary number of abutting property owners, particularly so as I
;;understand the petition only carried the names of five signers.
I.
. yours very truly,
R. R. Smith, Receiver."
meeting adjourned at 12 O'clock noon. _
•
Attested:
Clefik of the Board
: • RD
