<br />The undersigned, HaSnaond C. Borntra.ger, upon his oath, shows to your honorable
<br />body, that on the 20th.9 day cf February, 1924, you approved the final assessment roll
<br />for the improvement of so much of Elwood Avenue, as lies between College Street and.
<br />Adams Street, and among other tracts and lots of land abutting thereon, assessed the
<br />following unplatted tra et of la nd abutti ng on tha t part of said Elwood Avenue , so im-
<br />proved for the sum of Seven Hundred Fifty Seven Dollars and Seventy Cents (757.74) as
<br />its part of the cost of such improvement, viz.: West one-half (2) of the East one-hal-
<br />ti) of the Southeast one -quarter (4) of Section Thir ty-f our (34) Township Thirty-eight
<br />(38) Nor th , Range two (2) East, ba ck a distance of One Hundred Fifty (150) feet from
<br />the property line thereof and at that time the Securities Investment Corporation was
<br />the owner in fee simple thereof. That since said assessment was made and approved by
<br />your h onorab le bod y, t he said - Securi tie s Inve stmei t Corporat ion has pl atted sai d tract
<br />of land by dividing it into Sixty (60) lots extending back One Hundred Thirteen (113)
<br />feet on the lots facing Elwood Avenue, and back One Thousand Eighty (1080) . feet on lot;
<br />facing Adams and College Streets, which plat was duly signed and acknowledged by the
<br />Securities Investment Corporation on the 3rd., day of December, 1926, before a notary
<br />punlic , approved by your honorable body on the 21tst. , day of December, 1926, filed in
<br />the Recorders office of St. Joseph County, Indiana, on the 22nd. , day of August, 1927,
<br />for recording, and afterwarded recorded in Plat Book No.12, Page 150.

<br />That said assessment was made , the Securities Investment Corporation on the
<br />day of 19 T, and within thirty days after allowance of said final
<br />assessment or allowance for said. improvement, entered into an agreement in writing
<br />reciting that they desired to exercise this privilege of paying on said assessments'in
<br />ten annual payments and geed that in consideration of such privilege they would make
<br />no objection to an illegality cr irregularity with regard to the assessment against
<br />said tract of land and would pay the sere as required by law with the 'rate of interest
<br />required, which agreement they filed with the Controller of said City.
<br />That said tract of land , as shown on said plat, was divided into sixty (60)
<br />lots numbered from One Hundred twenty one (121) to One Hundred eighty (180) and lots
<br />numbered from One Hundred Twenty-one (121) to One hundred twenty-six (126) inclusive,
<br />abut upon that part of said Elwood Avenue so improved and assessed, and that thetsaid
<br />Securities Investment Corporation have not sold any cf said lots abutting on said
<br />Elwood Avenue, but have sold lots One Hundred Fifty -four (154) and One Hundred Fifty-
<br />five (155) , which lots face College Street, and which nea r&st line is One Thousand
<br />Thirteen (1013) feet from said Elwood AvEn
<br />That there are four cf said assessments amounting to Three Hundred Fifty Seven
<br />Dollars and Sixty-four Cents (357.64) and ninety Four Dollars and Eighteen Cents (94.1
<br />interest unpaid. and penalty, and one installment in the amount of Seventy Eight Dollar
<br />and Four Cents ($98.04) due and payable in 1933.
<br />Wherefore, the undersigned, prays that your honorable body will reassess the
<br />unpaid amount of said improvement assessment, including all unpaid interest now due
<br />thereon so that each cf said abutting lots of . said new sub -division, as shown on said'
<br />approved plat, shall bear its part and equitable proportion of said original unpaid
<br />assessment, and all interest now due thereon, and requests that all re-asses.sme.nt pay
<br />ments fall due in the remaining years of the original ten year period, and on the same
<br />date.
