JOSEPH COUNTY) SS <br />IN T FT t A_T'_IMM OF RESOLUTION) <br />PROVIDING FOR GRADE SEPARAI <br />TION OF RAILROAD TRACKS AT) <br />DIVISION AND 17ALNUT STREETS) <br />BEFORE THE BOARD OF PUBLIC H<-S <br />OF THE CI'1"'Y OF SOUTIE BEND INDIANA <br />We, the undersigned residents and citizens of the City of South Bend <br />St, Joseph County, Indiana, respectfully represent and show that we are the owners <br />of real estate abutting on Division Str�-et adjacent to the intersection of Walnut and <br />Division Streets in the City of South Bend, Indiana, and that all of our separate <br />pieces and parcels of real estate so abutting upon said Division Street will be affect- <br />ed by the proposed improvement; that said realestate owned by each of the undersigned <br />is now occupied .by buildings used for business purposes; that the proposed separation <br />of railroad tracks by the construction of a subway under the seine, as shown by the <br />plans now on file with the Board of Public Wcsks, will ruin and destroy each separate <br />and several piece and parcel of real estate and the buildings thereon situated owned <br />by the midersigned in so far as the -same would be useful for business purposes; that <br />the plan proposed is unjust, unreasonable, and is not the cheapest and best plan <br />that can be adopted for accomplishing the proposed imnro vement ; that the plan should <br />be modified. in this, that The New York Central Railroad Company be mquired to elevate <br />its tracks above the present grade to a sufficient height that the depression in the <br />street meking proper clearance under and through said. subway will minimize the damages <br />to the reppective real estate owners adjacent to said improvement; that under the <br />present plan the realestate of this remonstrator, Anthony Buchholtz, on the south side <br />of Division Street to the west side of Walnut Street will be approximately eight (8) <br />to eight and one half (82) feet above the pavement of said street in front of his <br />buildings if said improvement is made as proposed and on the plan now before the Board <br />of Public Works; that the real estate of John P. Rozplochowski and others on the north <br />side of Division Street west of said proposed improvement will be six (6) to seven <br />(7) feet above the pavement on said street and the real estate of Mrs. Josephine <br />Brambe rt is on the north side of Division .3treet east of said proposed improvement <br />and the pavement of Division Street in front of her real estate will be nine (9). <br />feet lower than her real estate, and the buildings situated thereon; that the real <br />estat e owned by the remons trator , Samuel Burke , on the s outh si de of Division Street, <br />and if said improvement is made under the proposed plan now on file the pavanent on <br />Division Street will be nine (9) to ten (I0) feet lower than the buildings on his real- <br />estate; that all of said buildings have basements underneath the s'arue, and if they sho <br />should undertake to lower said pavement said basements would be ruined; that the sew- <br />erage on Division Street is not sufficiently law so as not to affect the basements; <br />that portions of said. buildings cannot be lowered nor rebuilt to make the same ade- <br />quete for business purposes; that the proper specifications and plans for the improve- <br />ment proposes would require and provide that the tracks of the Railroad Company?; be <br />elevated where the same crosses Division Street approximetely six (6) feet in order to <br />make said proposed work feasible and to render servicable and useful the bhildings <br />adjacent thereto. <br />'Re therefore, remonstrate and pray that the same be modified to <br />the end that the tracks where the sane cross Division Street be elevated as herein <br />prayee. <br />ANTAHTONY S. Joseph and <br />State of Ind iane , which grope rty abut is upon Division litreet and will be affected by <br />the proposed additional improvement to elevate the rpilroad trr cks of the New York <br />Central nailroad at the intersection of Division and Walnut Streets; that the property <br />of the undersigned is occupied by buildings used. for business purposes; that the pro- <br />posed separation of the said railroad tracks by the proposed elevation of said tracks <br />ah.d the construction of a sub -way under the same as shown by the plans now on file <br />with said Board of Public Works wi 11 destroy the real e state of the und ersigned, and <br />particularly the building thereon fbr business purposes and- that said property cannot <br />be used for any other purpose; that the proposed plan with respect to the, undersigned's <br />property will lower the I Bement on Division Street from nine to ten feet laver than <br />the present grade level of the buildings of the und ersi gned ; that said buildings have <br />P basement und. erneath of the same and if the p zopos ed plan is f ollowed it, would. ruin <br />and destroy the basement thereunder; that the sewerage on Division Street is not <br />
