Area Board of Toning Appeals — .lanuary 6, 2010 <br />what the staff recommendation was. I'm going to amend the petition so that we don't actually need number <br />one. We're going to move the tank over so that it actually is 10' off the side yard setback line. <br />MR. FEDDER: So variance A -I is out? <br />MR. RANCH: So A -1 we do not need. And number two, what we're going to do is we're going to amend <br />that and we are actually going to put landscaping along the west side and along the south side of where the <br />tank is going to be located. And that pretty much matches what the staff had asked us to do. What we're <br />asking for, this piece of property is right up on the corner the northwest corner Deahl Ct. and Cleveland <br />Road. It's a multi tenant building there at 3371. Cleveland Road. NUCO2 basically wants to go in the <br />building but they need to have an outside storage area for their carbon dioxide tank. Under the City <br />requirements for that type of use they consider it, I guess, a gas bottled distribution facility. We need a <br />Special Exception so I need your recommendation for the Special Exception for the tank and the variance <br />that we're just requesting is basically is to be allowed to put it as we had showy with the representation that <br />we're going to put Evergreen .screening along the west side of where the tank is and the chain link fencing <br />and also we're going to put landscaping along the south side. That's all we need. <br />MR. URBANSKI: And the gate's along the south side? <br />MR. DANCH: Yeah but what we'll do though, where you see the gate to just to the west of that, we're <br />going to rip up the pavement there and I'm going to put some landscaping, Evergreen screening there too. <br />And I think one last variance that I didn't change that I usually ask for is that they're going to put a 10' <br />screening fence, solid screening fence around where the tank is but because of the height of the tank with <br />what they call, there is some piping up above it, that would stick up above the fence by 4'. So one of the <br />variances was to be allowed to have anything sticking above the fence by a maximum of 4'. <br />MR. VELLEMAN: You're putting up a white vinyl fence? <br />MR. DANCH: Actually we met with the Design Review Committee yesterday with the City and it will end <br />up being a beige fence because it will match the facade of the building. <br />MR. PHIPPS: Mike the part of the tank that is 4', it's not the full 30' in length as on the site plan? <br />MR. DANCH: They have the piping Jerry. It's the air pipes or whatever they're called. <br />MR. FEDDER: .lust for the record then, we're going to be voting on which variances? <br />MR. DANCH: Well I need the recommendation for the Special Exception and on number two I just need <br />the approval that the way I've represented that we' 11 do the landscaping on the west side and the south side <br />will meet the intent of the ordinance and number three that I'm allowed to have that extension up to 14' up <br />above the 10' fence. <br />MR. PHIPPS: Is there part of number two that doesn't comply with the ordinance? <br />28 <br />
