<br />Board met in regular session at 9 A. Tr. All members present.
<br />Minutes of :Imeetings held July 17th. , and July 18th. , 1928, read and
<br />i approved.
<br />The Board signed the contract with Albert Construction Company for the
<br />pavement on O'Brien Street from Lincoln `ray 4est to Elwood. Avenue under Improvement
<br />Resolution No.20351 in the amount of 27, I73.20. The Board also approved the con-
<br />struction bond of same for 50% of the contract price signed by Inland Bonding Co.
<br />l'he Board. approved the excavation bond of Robert Thorpe in the amount
<br />of 1,000.00 signed by Fidelity and Casualty CO., of New York.
<br />The Board approved the renewal certificate fzr the excavation bond
<br />of Louis Stoll signed by Lletropolitan Casualty Insurance o.
<br />The Board approved the Guarantee Bond of 41iilistoq Construction ompany
<br />for the improvement on 2Tst. , Street from Jefferson to }Wilson treet under Improve-
<br />ment Resolution No.2056 in the amount of 1,069.03 signed by Inland Bonding Co.
<br />In the matter of Improvement Resolution No.2068 for the pavement on
<br />Angella Avenue from Leeper Avenue to Bast line of Harter 'Heights Addition, the
<br />Board hereby rescinds all former action taken on said resolution and declares same
<br />null and void and the proceedings closed. -
<br />This being the date set, hearing was had on Supplementary Resolution
<br />No. Ii74B with reference to Northwest Irunk and 'pub -trunk Sewer Improvements.
<br />In the above named improvement resolution No.1774B, no remonst_:,tors j
<br />appeared and no written remonstrance was filed and the Board, being fully advised
<br />in the premises, finds that the district or area is properly bounded f4 the purpose';
<br />of such drainage and that the sub -trunk districts or areas are properly bounded
<br />for the purpose of draiina-gb-bfhimkch subtrunks; that the real estate included in such !,
<br />district will be benefited by such drainage; that the special benefits to the
<br />several lots and parcels of land within such area or sub -trunk areas and the City
<br />by reason of such proposed improvement, will be equal to the estimated cost of said
<br />improvement. The Board, -therefore, decides to take final action on said supplemental
<br />resolution No.1774B, and declares same in all things ratified, confirmed and approved
<br />and the proceedings closed.
<br />This being the due set, hearing was had on Improvement Resolution
<br />No.2I08 for the Bergan and Johnson *4treet Trunk Sewer.
<br />In the above named improvement resolution, no remonstrators appeared
<br />and no written remonstrance was filed and the Board, being fully advised, in the
<br />-premises, finds that the district or area is properly bounded for the purpose of
<br />such drainage; that the real estate included in such district will be benefited by
<br />such drainage; that the special benefits to the several lots and parcels of land
<br />within such area or district and to the City by reason of such proposed improvement
<br />will be equal to the estimated cost of said improvement. The Board, therefore,
<br />takes final action on said improvement resolution No.2I08 and declares aame in all
<br />things ratified, donfirmed and approved without modification.
<br />InXthe matter of Improvement Resolution l:To.2I08 for the Bergan and
<br />Johnson Street trunk Sewer, the Board, hereby orders that on the 7th., day of
<br />August, 1928, this Board will receive, open and consider sealed proposals for the
<br />construction of said trunk sewer up to I0:03 A. Y. The Board, further orders that
<br />notices of said proposals shall bepublished on the 26th. , day of July and on the
<br />2nd. , da-r of August, 1928, in the South Bend News Times and Tribune according to
<br />law.
<br />This being the date s>et, hearing was had on the assessment roll for
<br />the pavement and sewer improvement on Adams, College and Brookfield Streets in
<br />C. R. Smiths Subdivision under Improvement Resolution No. I976.
<br />In the above named assessment roll, no remonstrators appeared and no
<br />written remonstrance was filed and the Board, being ful],y advised in the premises,
<br />finds that the several lots and parcels of sand have been benefited in the amounts
<br />named on said assessment roll. 'The Board therefore, takes final action on said
<br />assessment roll filed July IOth., I928, and declares same in all things ratified,
<br />confirmed and approved without modification and the proceedings closed. The
<br />Board now orders said assessment roll delivered to the Department of Finance.
<br />j� City Lngineer, H. G. Wray, filed -lans, specifications and estimates
<br />and the Board adopted said plans and specifications together with Improvement
<br />Resolution No.2I26 for the pavement of Angella Avenue from east line of Harter
<br />iHeights Addition to Notre Dame Avenue.
<br />it In the above named improvement resolution No.2I26, property owners
<br />waived all objection on and in defense to any defect in said pr oceedings,and to any
<br />violation in procedure for the construction of street improvements as fixed by law.
<br />Whereupon the Board received, opened and read sealed proposals for the construction
<br />i
