The matter first given the attention of the Board was that of a triangular piece
of land on the west side of Michigan Street, lying between Samuel Leeper's 2nd Addition
and the Michigan Central Railroad tracks. The City Engineer, having made an investigation
in this matter, reported to the Board that the area described is not property of the
'City, and the Clerk was directed to so advise Attorney Robert K. Rodibaugh in reply to
'ihis inquiry dated March 25, 1955.
Consideration was next given to the request of Mary Bella, Poppy Day Chairman,
!American Legion Auxiliary, Post 50, that permission be granted the American Legion to
'conduct their annual poppy sale on Friday and Saturday, May 20th and 21st. These dates,
'having previously be established for the D. A. V. Forget -Me -Not Day, and Ward Anderson,
!Adjutant, D. A. V. Chapter 6, being present and opposed to sharing these dates with the
;American Legion, considerable discussion was given the matter. It was the final decision
of the Board, inasmuch as both organizations are representative of the war veterans, and
,the American Legion was agreeable to conducting Poppy Day jointly with the D. A. V.
:Forget -Me -Not Day, to grant permission to American Legion Auxiliary, Post 50, for the
;dates of May 20th and 21, 1955, and it was so ordered.
Petition, dated February 1, 1955, for sewer line on 33rd Street, between Jefferson;;
.and Washington Streets, in Jefferson Acres Addition, was referred to the City Engineer,
The Board then proceeded with the hearing in the matter of taxicab license for
,Andrew Ligos and Donald A. Heilman. It was pointed out to Mr. Ligos by City Attorney
I. A. Hurwich that license can only be issued to him upon the surrender of Taxicab
!License No. 1, now held by Earl Stacher. Mr. Heilman was informed that upon the
surrender of Taxicab License No. 9, presently held by Earl Stacher, a license in replace-'
ment may be issued to Donald A. Heilman. Mr. Heilmants attention was called to a record
!'of traffic violations, now some years past, and he was warned that another such violation!'
would.jeopardize his license.
VACATION RESOLUTION NO.2808 - 1955
This being the date set, hearing was had on the Resolution heretofore adopted
by the Board of Public Works and Safety for the vacation of Lafayette Boulevard from the
north line of Farneman Avenue (now vacated) to the north line of Tasher Avenue and from
the south line of Tasher Avenue to the north line of Jennings Avenue, and from the south
line of Jennings Avenue to the north line of Dean Street, and from the south line of
Sherwood Street and from the a)uth line of Sherwood Street to the north line of the first;
alley south of Sherwood Street, under Vacation Resolution No. 2808. The Clerk of the
Board having shown sufficient proofs of publication and no remonstrators having appeared
it was moved, seconded and unanimously carried that the said resolution be finally adopter
and said portion of street be vacated. The Engineering Department is directed to prepare;
an assessment roll covering the assessment of benefits and the award of damages to the
surrounding properties.
STREET DEPARTMENT:
H. M. Tomlinson, Street Commissioner, being present, brought to the attention of
the Board, the dust condition now prevailing on that section of Riverside Drive over
which heavy traffic connected with the Sewage Treatment Plant construction activities
is presently routed. The Commissioner was directed to oil this section and was advised
that cost of oil so used would be borne by the Sewage Works Construction fund. -
It now being the time set by legal advertising for the opening of bids, announce-
ment was so made and the Board proceeded in this matter, as follows:
GADBURY IMPLEMENT SALES & SERVICE AGENCY
4514 So. MICHIGAN ROAD
SOUTH BEND, INDIANA
non-col1usidnaa ll upon the opening of bid, discovery was made of failure to provide a
fidavit, and bid was, thereupon, rejected.
