<br />It is ordered and decreed, and there is hereby appropriated for the use of the
<br />City of South Bend, Indiana, or its successors, the right to lay, maintain, operate,
<br />alter, repair -and remove a sewer; lift station, river crossing entrance chamber, manholes',
<br />structures, pumping staions and appurtenances, including utility poles and/or guy- wires
<br />connected therewith, through and over the following described real estate in St. Joseph''
<br />County, State of Indiana, to wit:
<br />A parcel of land lying East of the intersection of Edgewater Drive andLi
<br />Monroe Street as shown on the recorded plat of Edgewater Place.Addition,
<br />to the City of South Bend, bounded by a line running as follows, to wit:
<br />Beginning at the intersection of the easterly line of Edgewater Drive and
<br />the southerly line of Monroe Street projected easterly, thence easterly
<br />on the southerly line of Monroe Street projected easterly to the low-water
<br />mark of the St. Joseph River; thence downstream along the low-water mark
<br />of said River to the center line of Monroe Street projected easterly; thence
<br />West along the center line of Monroe Street projected easterly to the East
<br />line of Edgewater Drive; thence South Along the easterly line of Edgewater
<br />Drive to the place of beginning.
<br />Tract 4
<br />It is ordered and decreed and there is hereby appropriated for the use of the
<br />City of South Bend, Indiana, or its successors, the right to lay, maintain, operate,
<br />alter, repair and remove a sewer, lift station, manholes, structures, pumping stations
<br />and appurtenances connected therewith through and over the following described real
<br />estate in St. Joseph County, State of Indiana, to wit:
<br />A parcel of land taken from Lot Numbered 11 in Miller and Green's First
<br />Addition to the Town of Lowell, now the City of South Bend, bounded by a
<br />line running as follows, to wit: Beginning on the South side of Colfax
<br />Avenue at a point 253.93 feet West of the Northeast corner of said Lot 11
<br />in Miller and Greents First Addition; thence West along the North side of
<br />Lot 11 a distance of 14.5 feet; thence South perpendicular with the North
<br />line of said Lot a distance of 4-1 feet; thence East parallel with the
<br />North line of said Lot 11 a distance of 14.5 feet; thence North 4-1 feet to
<br />the place of beginning, which point is 739.65 feet West of the intersection
<br />of the South line of Colfax Avenue and the West line of Niles Avenue in the
<br />City of South Bend, Indiana.
<br />And the Board now orders that a list or roll be prepared of all owners or
<br />holders of property and of valuable interest therein sought to be taken, which list
<br />or roll shall also describe the property either injuriously or beneficially affected.
<br />The Board again took up for consideration the matter of the possibility of
<br />relocating the proposed 24" sewer across the property of the V.F.W. and having been
<br />quoted the cost of such re -location, the Board directed the Clerk to notify the V.F.W.
<br />committee concerning such cost and request their decision as to whether or not they
<br />will assume the necessary expenditure for such re -location.
<br />STREET DEPARTMENT:
<br />Street Commissioner, H. M. Tomlinson, being present, discussion was entered into
<br />at some length concerning weed -cutting operations, the ineffectiveness of the present
<br />ordinance governing, and the need for revision or a new ordinance in this connection.
<br />No definite conclusion was made in the matter.
<br />The Board next examined price list and literature pertaining to the Apeco Auto-
<br />Stat and directed that this data be referred to Mr. Robert Huff for study in conjunction
<br />with his' study of the City+ s need for micro -filming equipment.
<br />Then appeared before the Board, Attorney Russell C. Kuehl with agreements bearing
<br />signatures of the institutional heads of Notre Dame University and St. Maryts College,
<br />relative to the connecting of the sewers from each of those institutions with the
<br />sewage disposal system of the City of South Bend. Agreements were examined, approved,
<br />and signed by the Board for forwarding to the Common Council for further action this
<br />date.
<br />The time now being 11:00 otclock, it was so announced, and the Board then pro-
<br />ceeded with the opening of bids, -as follows:
