162 <br />UNDER Vacation Resolution No. 2772. <br />In the above named assessment roll, no remonstrators appeared and no written <br />remonatrances were filed, the Clerk of the Board submitted proofs of publication of <br />notices and same were found sufficient, and the Board, therefore, finds that the several <br />lots and parcels of land have been benefited and damaged in the amounts shown on said <br />roll. The Board, therefore, decided to take final action on said assessment roll and <br />declares same in all things ratified, confirmed and approved without modification and <br />the proceedings closed, and the alley vacated upon receipt of the amount of benefit <br />assessments from the various property owners so benefited and all proceedings had with <br />referene7e to said alley vacatinn are hereby sustained. <br />VACATION RESOLUTION NO. 2774 - 1954 <br />This being the date set, hearing was had on the resolution heretofore adopted by <br />the Board of Public Works and Safety for the vacation of SORIN STREET FROM PRESTON <br />DRIVE TO THE EAST LINE OF THE RECORDED MCKINLEY TERRACE ADDITION TO THE CITY OF SOUTH <br />BEND, INDIANA, under Vacation Resolution No. 2774. The Clerk of the Board having shown <br />sufficient proofs of publication and no remonstrators having appeared and no written <br />remonstrances having been filed with the Clerk, it was moved, seconded and unanimously <br />carried that the said resolution be finally adopted and the said street be vacated. <br />The Engineering Department is directed to prepare an assessment roll covering the <br />assessment of benefits and the award of damages to the surrounding properties. <br />Mr. R. S. Andrysiak, City Engineer, filed primary assessment roll showing the <br />awards of damages and the assessments of benefits in the matter of vacation of a portion <br />of Sorin Street, under Vacation Resolution No. 2774. <br />In the above named assessment roll, the Board hereby orders that it will meet in <br />the City Hall at 10:00 A. M. CST on the 24th day of May, 1954, for the purpose of hear- <br />ing and receiving remonstrances from all persons interested in or affected by said <br />vacation, and the Board further orders that notice of said hearing, together with the <br />amount of damages awarded and benefits assessed be addressed to the property owners <br />by publishing same on the 30th day of April, on the 7th day of May, and on the 14th <br />day of May, 19511 in the South Bend Tribune and the Tri-County News. <br />The Board then took up the matter of the bids received and opened in the regular <br />meeting of March 29th, to supply the City with complete micro -filming equipment, and <br />with the micro -filming of the birth and death records of the Department of Public <br />Health from the year 1882 to and including the year 1936. The two bids received <br />were rejected by the Board, and discussion was given to the matter, resulting in the <br />consensus of opinion that a study of the needs of those departments of the City govern- <br />ment which could advantageously use this service. It was agreed that before making a <br />decision as to whether to purchase micro -filming equipment, or to enter into a contract <br />for the micro -filming of records and the continuance of such service, the matter is <br />of sufficient import for the appointing of a committee to make a study of the subject <br />from all angles, investigating the experience of local banks and other institutions, to <br />determine the equipment or method best suited to the Cityls needs. Mrs. Elizabeth <br />Wappenstein, representing the Health Department, participated in the discussion. <br />The Board next examined description and drawing, covering new utility easements in <br />McKinley Terrace Addition, made necessary by the Vacation and relocation of Sorin Street <br />These were found to be satisfactory. <br />The Board next examined description and drawing, covering utility easements off <br />the northerly side of Lot 631 and off the southerly side of Lot 634, McKinley Terrace, <br />Section B. These were found to be satisfactory and the Board directed the Clerk to <br />proceed to have these easements recorded. <br />IMPROVEMENT RESOLUTION NO. 2771 - AWARDING CONTRACT <br />Engineerts Report, submitted by Wilbur H. Gartner & Associates, having been re- <br />ceived and examined by the Board, in the matter of bids for the improvement of NORTH <br />ELMER STREET from the center line of Elwood Avenue to the center line of Keller Street <br />by constructing a local sewer in accordance with Improvement Resolution No. 2771, 1954, <br />passed by the Board of Public Works and Safety on March. 15, 1954, and confirmed by <br />the said Board on April 5, 1954, the bid was awarded to Niles Excavating Company for <br />the sum of $7804.00. <br />The application of Walter D. Pennington for Taxicab License, and pertinent papers <br />attached thereto, was next examined and it was the consensus of opinion that the re- <br />quired insurance could not be obtained by Mr. Pennington, in view of his accident <br />recordd. The matter was accordingly tabled, and the papers ordered filed. <br />STREET DEPARTMENT: <br />H. M. Tomlinson, Street Commissioner, being present, brought to the attention of <br />the Board, the flood condition of Bowman Creek, now causing interference with traffic <br />at the Main Street and Fox culverts. The suggestion was offered that it is within <br />the jurisdiction of the County Commissioners to provide a dam to retain the flood water <br />of this creek for controlled release throughout dry -weather periods. <br />Commissioner Tomlinson also took up with the Board a situation which now arises <br />• <br />LJ <br />0- <br />
