r <br />102 <br />FURTHER RESOLVED that the form of ordinance drawn for such purpose <br />by Russell C. Kuehl, the Special Counsel employed by the City, which <br />form of ordinance is hereby approved, be submitted to the Common <br />Council with the request that the same be adopted. <br />Adopted this 7th day of December, 1953. <br />R. Hurwich <br />Board of Public Wor s & Safety <br />VACATION RESOLUTION NO. 2765 - 1953 <br />This being the date set, hearing was held on the assessment roll showing the award <br />of damages and the assessment of benefits in the matter of the vacation of the ALLEY <br />between Caroline street and Eldora Court, from the north line of Delbert Court to the <br />south line of the alley north of Delbert Court, under Vacation Resolution No. 2765• <br />In the above named assessment roll, no remonstrators appeared and no written <br />remonstrances were filed, the Clerk of the Board submitted proofs of publication of <br />notices and same were found sufficient, and the Board, therefore, finds that the several <br />lots and parcels of land have been benefited 7and damaged in the amounts shown on said <br />roll. The Board, therefore, decided to take final action on said assessment roll and <br />declares same in all things ratified, confirmed and approved without modification and <br />the proceedings closed, and the portion of the alley vacated upon receipt of the amount <br />of benefit assessments from the various property owners so benefited and all proceed- <br />ings had with reference to said alley vacation are hereby sustained. <br />VACATION RESOLUTION NO. 2766 - 1953 <br />This being the date set, hearing was had on the resolution heretofore adopted by <br />the Board of Public Works for the vacation of A PART OF SHERMAN AVENUE under Vacation <br />Resolution No. 2766. The Clerk of the Board having shown sufficient proofs of publica.' <br />Lion and no remonstrators having appeared and no written remonstrances having been filed <br />with the Clerk, it was moved, seconded and unanimously carried that the said resolution j <br />be finally adopted and the said street be vacated. The Engineering Department is <br />directed to prepare an assessment roll covering the assessment of benefits and the award"{ <br />of damages to the s9ourrounding properties. <br />A letter addressed to the Board of Public Works and Safety, from the law firm of <br />DuComb, Nimtz and DuComb, under date of December 7, 1953, was found to pertain to <br />matters under the jurisdiction of the Board of Water Commissioners and was, accordingly, <br />referred to the City Water Works. <br />A letter from the Chicago, South Shore & South Bend Railroad, under date of <br />November 30, 1953� pertaining to the "dip" in Orange Street, was noted by the Board <br />and Street Commissioner, H. M. Tomlinson, and ordered filed. <br />Excatation Bonds, each in the sum of $1,000.00, were examined by the Board and <br />approved for the following: <br />J. B. Fleck & Sons & Company <br />Hawblitzel House Plumbing & Appliances <br />Mitchel Kahn Plumbing & Heating Company <br />Emmet Shaul <br />Albert W. Smith Company, lnc. <br />Emil C. Spromberg <br />Louis Stoll Company, Inc. <br />Howard H. White & Son <br />Contractors Bonds, each in the sum of $1,000.00, were examined by the Board and <br />approved for the following contractors: <br />Glen R. Davis <br />C. Powell and Eddie Larren, d/b/a C. Powell & Company <br />L. J. Shoemaker <br />There being no further business to come before the Board, the meeting adjourned <br />at 1.1:4A.
