• <br />0 <br />A Storm Sewer Plan for that portion of Corby Street, located in McKinley Terrace <br />Addition, Section "B", bearing the date of November 9, 1953, and certified by Wm. S. <br />Moore, Engineer, was examined and approved by the Board. <br />The Certificate of Insurance provided by Continental Casualty Company, by Carl <br />W. Ginz, Inc., for the protection of the Association of Commerce of South Bend, Indiana <br />& Michigan Electric Company and the City of South Bend, in the matter of public liability <br />involving Christmas Decorations for the nine city blocks, as specified in the certificate <br />for the period of November 14, 1953 to January 31, 1954s was examined by the Board and <br />ordered placed on file. <br />A public utilities easement, recorded in the Office of the St. Joseph County <br />Recorder in Book 521, Page 465, No.91863, granted the City-of.South Bend, by John and <br />Luella Van Vynckt, Husband and wife, was approved and accepted by the Board, and ordered <br />f iled. <br />VACATION RESOLUTION NO. 2766 - 1953 <br />RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF SOUTH BEND, INDIANA*- <br />That it is desirable to vacate the following: <br />A PART OF SHERMAN AVENUE DESCRIBED AS FOLLOWS: <br />BEGINNING AT'THE NORTHWEST CORNER OF LOT 19, <br />WM. MILLERIS ADDITION, THENCE WEST 14.60 FEET; <br />THENCE SOUTHEASTERLY A DISTANCE OF 34.03 FEET; <br />THENCE EAST 6.30 FEET TO THE WEST LINE OF SAID <br />LOT 19; THENCE NORTH ALONG THE WEST LINE OF <br />LOT 19,: A DISTANCE OF 33 FEET TO THE PLACE OF <br />BEGINNING. <br />The following property may be injuriously or beneficially affected by such <br />vacation: <br />Lot Numbered 19, Wm. Miller's Addition <br />Notice of this resolution shall be published on the 20th day of November and on <br />the 27th day of November 1953 in the South Bend Tribune and Tri-County News. <br />This Board, at its office in the City Hall, on the 7th day of December 1953, at <br />11:00 A. Hahn and Walter Glass, bringing t <br />;;the Boardts attention, the deliberate blocking of East Colfax Avenue, from Ironwood <br />Drive to Tuxedo Drive, bythe use of a bulldozer to make this thorofare impassable. The <br />1jcouncilmen were informed by -the Board that suit is pending to obtain a declaratory <br />judgment to establish easement for the thorofare, and failing in this, East Colfax <br />• ;Avenue can be opened by exercising the right of eminent domain. <br />
