32 <br />Wilbur IL Gartner, Civil Engineer, being present, reported to the Board., the condition of sewer the � <br />in that section of Kemble Street where basements have.been flooded and sewer repair is now under way <br />by the Niles Excavating Company, in accordance with authorization given by the Board in regular meeting <br />of June 15th. Engineer Gartner stated that every section of pipe taken up thus far in their operations <br />has been found to be cracked. He also reported an extensive hollow area under pavement was discovered <br />at one point. The work having proceeded past the four homes affected, and the basement flooding having !! <br />subsided, the Board directed that further operations by Niles Excavating Company cease at this point, <br />and further directed Street Commissioner H. M. Harry �+ <br />Swanson, Inc. and others for the improvement on TUXEDO DRIVE from the north line of Washington Avenue I <br />to the south line of McKi.nly Avenue AND <br />i <br />�i <br />PETITION OF George W. TiTilliams and twenty-six others for the improvement on UAWTION STREET from <br />the west line of Olive Street to the east line of Washington Street. I <br />i <br />The above petitions were examined by '-.he Board and -referred to the City Engineer nor -recommendation. I, <br />The City Engineer being present, made the recommendation that the petition be granted. The Board then <br />directed that the firm of Wilbur H. Gartner & Associates prepare general details, drawings, specifications,il <br />and preliminary improvement resolutions for the two pavement Lmprovements to be constructed and the firm <br />was so notified June 22, 1953. j <br />Mr. Wilbur H. Gartner next appeared before the Board and reported that nothing has been done on the <br />part of Tri-State Excavators to complete the work undertaken by them, in accordance with contract awarded <br />1 <br />them, in the 1800 block north Huey Street. In view of the accident which occurred owing to the con- <br />it <br />tractor's negligence, involving personal injury, and. the contractor's continued neglect, the Board <br />directed the Street Commissioner to continue the use of warning lights at night, and directed the clerk <br />to notify Tki-State Excavatorq to have -the half -block, which at this time remains in dangerous condition, <br />I! <br />placed in safe and satisfactory condition for traffic by 4:30 P. M. Wednesday, June 21,,th, otherwise, the <br />Street Department will proceed with the work of restoring the street to proper condition, all costs to <br />be charged against Tri-State Excavators. The Board further directed that letter, so notifying this <br />! <br />contractor, is to be presented to them by a police officer. <br />Maintenance Bond, in the sum of $1965.08. binding Reed Construction Compan-y as principal, and <br />I� <br />Indemnity Insurance Company of North America; as surety, pertaining to the maintenance of specifically <br />described pavement on Miami. Street, was examined and approved by the Board. <br />Maintenance Bond in the sum of 89,330.50, binding Reed Construction Co., as principal, and Indemnity <br />Insurance Company, of North America, as surety, pertaining to the maintaining of specifically described <br />pavement on Byron Drive, was examined and approved by the Board. <br />�I <br />The following Contractor's. -Bonds, each in the sum of }1,000.00 were examined and approved: <br />l <br />Edward Burton <br />!! <br />H. G. Christman Construction Co., inc. <br />I <br />Hartman Builders, Inc. <br />Tom Kruszynski <br />Russell Platz. <br />Then appeared before the Board-, Mr. 011ie B. Love, complaining of condition of street in the 100 <br />block south Iowa Street. The Board explained in considerable detail that until some paving contractor <br />is willing to submit a proposal and satisfactory bond for the paving of Iowa Street or any portion of <br />the Street, the City cannot proceed with any improvement, other than a dust -laying and bonding coat <br />.of bituminous oil, in which event, it is first required that the home-oomer residents raise a sufficient <br />,fund to meet the cost of the required quantity of bituminous material. It was pointed out to Mr, Love <br />that currently there are but two contractors, bidding on paving improvements for the City, and to the <br />best knowledge of the Board, neither of these firms would offer a bid, were the City to advertise for <br />the, asphalt or concrete paving of Iowa Street. City Attorney, I. A. Hun -rich, explained the entire !1 <br />procedure for the financing of street improvements for T,tr. Love's complete understanding of the <br />situation currently presented. <br />There being no further business to come before the Board, the meeting adjourned at 11:30 A.
