<br />Memorandum of Mayor John A. Scott,
<br />under date of May 22nd, was read and considered,
<br />It was the decision of the Board that
<br />the period from 10:00 to 10:30 A. M. of each
<br />regular meeting will be reserved for
<br />any and all citizens having matters to transact
<br />or bring before the Board. The period
<br />from 10:30 to 11:30 A. M. was designated
<br />for
<br />hearing from the various department heads, with the stipulation that the first
<br />to be
<br />heard at 10:30 sharp is to be the Street
<br />Commissioner. It was also stipulated
<br />by the
<br />Board that the Traffic Engineer is to
<br />be available, on call, from 10:00 A. M. until
<br />• 12:00 noon on the regular meeting day
<br />of the Board.
<br />A letter from the law offices of Hammerschmidt & Johnson, under date of May 21st,
<br />addressed to the City Comptroller and enclosing three copies of Agreement between the
<br />Board of Public Works and the Board of County Commissioners, was next read and examined..'
<br />The agreement, dedicating for street purposes a 30-foot strip of land off the entire
<br />east side of Veterans' Memorial Park, and conveying to the City of South Bend the real
<br />estate now comprising-Pottawatomi Park in fee simple, was found to be satifactory and
<br />in order, and was accordingly signed and accepted by the Board of Public Works.
<br />VACATION RESOLUTION NO. 2754 - 1953
<br />. This being the date set, hearing was had on the resolution heretofore adopted by
<br />the Board of Public Works for the vacation of STREETS AND UTILITY EASEMENTS IN THE
<br />RECORDED PLAT OF BELLEVILLE UNIT "D", AN ADDITION TO THE CITY OF SOUTH BEND, INDIANA,
<br />EXCEPTING SUCH PORTIONS OF SAMPLE STREET AND MAYFLOWER ROAD AS MAY LIE WITHIN THE
<br />BOUNDARIES OF SAID PLAT under Vacation Resolution No. 2754•
<br />The Clerk of the Board having shown sufficient proofs of publication and no
<br />remonstrators having appeared and no written remonstrances having been filed with the
<br />Clerk, it was moved, seconded and unanimously carried that the said resolution be
<br />finally adopted and the streets and easements be vacated. The Engineering Department
<br />is directed to prepare an assessment roll covering the assessment of benefits and the
<br />award of damages to the surrounding properties.
<br />• R. S. Andrysiak, City Engineer, filed primary assessment roll showing the awards
<br />of damages and the assessments of benefits in the matter of the vacation of STREETS
<br />AND UTILITY EASEMENTS IN THE RECORDED PLAT OF BELLEVILLE UNIT !rD", an ADDITION TO THE
<br />CITY OF SOUTH BEND, INDIANA, EXCEPTING SUCH PROTIONS OF SAMPLE STREET AND MAYFLOWER
<br />ROAD AS MAY LIE WITHIN THE BOUNDARIES OF SAID PLAT.
<br />In the above named assessment roll, the Board hereby orders that it will meet
<br />in the City Hall at 10:00 A. M. CST on the 22nd of June 1953, for the purpose of hearing'
<br />and receiving remonstrances from all persons interested in or affected by said vacation,'
<br />and the Board further orders that notice of said hearing, together with the amount of
<br />damages awarded and benefits assessed be addressed to the property owners by publishing'
<br />• same on the 29th day of May, on the 5th day of June and one the 12th day of June 1953,
<br />in the South Bend Tribune and the Tri-County News.
<br />A Construction Order submitted by the Northern Indiana Public Service Company,
<br />under date of May 20th, illustrating a proposed extension of gas main on Sample Street,
<br />along the north side of the street, connecting with the existing main approximately
<br />200 feet east of Wellington Street and terminating at Albert Street, was examined and
<br />approved.
<br />STREET DEPARTMENT:
<br />Street Commissioner, Harry PII. Tomlinson, being present, brought to the attention
<br />• of the Board, the urgency for the removal of the steel rails, and possibly steel ties,
<br />at the intersection of Westmoor and Bendix Drive, where the Bendix Aviation Corporation
<br />and the City Traffic Engineer desire to install a channelization island 3t the earliest
<br />possible date. It was considered probable that this intersection and the additional
<br />steel rails to be removed from these streets would produce a total of more than 700
<br />tons of steel, and that the salvaging of this steel and replacement of the street
<br />paving could probably be accomplished expeditiously and profitably for the City, through
<br />a private contractor. in view of the estimated amount of the salvage material involved
<br />and the eoonomy of handling the entire pavement job, rather than the intersection of
<br />Westmoor and Bendix Drive only, the Board placed the matter in the hands of the City
<br />Attorney to be presented to the Common Council for its approval, before proceeding
<br />with the required legal advertising.
<br />• The status of the dust arrester for the asphalt plant was also given further
<br />consideration and, it was pointed out, its delivery and installation can only be
