258 <br />i VACATION RESOLUTION NO. 2671 <br />f RESOLVED BY THE BOARD OF PUBLIC X RKS OF THE CITY OF SOUTH BEND, INDIANA: That it <br />I is desirable to vacate the following; <br />THAT PART OF EAST M ARION STREET BOUNDED AS FOLLOWS: Beginning at a point 201 feet <br />east of the northwest cornerof Lot 130 in the original plat of South Bend; Thence <br />north 15 feet; thence east parallel to the south line of Marion Street to the west <br />line of the St. Joseph River; thence southwesterly along the west line of the St. <br />Joseph River to the south line of Marion Street; thence west on the south line of <br />i Marion Street 343.28 feet mor or less to the place of beginning, said 15 foot strip <br />of East Marion Street being that part of said street lying north of the north pro- <br />perty line of Lot 118 in the original plat of South Bend and a part of vacated St. <br />Joseph Street immediately west thereof. <br />The following property may be injuriously or beneficially effected by such vacation <br />Lots numbered 1 to 6 inclusive, Hammond and4Wnitcomb Addition <br />and <br />j; Lot numbered 118 original plat of South Bend. <br />Notice of this resolution shall be published on the 20th day of April and on ,the 27- <br />day of April, 19%1, in the South Bend Daily Tribune and the Weekly Record. <br />This Board, at its office in the City Hall on the 7th day of May, 1951, at 10:00 <br />aom., C.S.T., will hear and receive remonstrances from all persons interested in or af- <br />fected by these proceedings. <br />Adopted this 16th day of April, 1951. <br />ATTEST: R. Bruggner <br />2 T - 4/20 - 4/27 BOARD OF PUBLIC 4'O RKS & SAFETY <br />VACATION RESOLUTION NO. 2659 <br />This being the date set for the continued hearing on Vacation Resolution 2659 for <br />the vacation of Marshall Street, comes now Leo P. Rieder, Attorney for the remonstrators <br />who presents to the Board the following agreement: <br />Board of Public Works <br />City of South Bend <br />South Bend, Indiana <br />I We, .,the undersigned, sole owners of Lots Numbered 11, 12, 13 and 14 of Jefferson <br />Heights Addition to the City of South Bend, Indiana, for value received, hereby agree j <br />to dedicate to the City of South Bend a strip of land across part of said lots, sixty <br />(60) feet in width, North and South and located at such a point as to constitute a con- !' <br />tinuation of Marshall Street projected west, with a cul-de-sac on the west end of Marshail <br />Street so projected west of a radius of approximately sixty-five (65) feet, all to be f' <br />approved by the Board of Public Works of said City. <br />We further agree to have the survey made and to perfect the said dedication within <br />a period of ninety (90) days from date hereof. <br />We also agree to release the City of South Bend from all damages by reason of the <br />laying out and opening of said street. <br />IN WITNESS WHEREOF, we have hereunto set our hands, this 13th day of April, 1951, <br />(Signed) Milo Dugdale <br />Fannie Dugdale <br />The Board, thereupon, decides to deny the petition to vacate Marshall Street, pro- <br />vided that the above dedication be executed within the 90 day period. <br />VACATION RESOLUTION NO. 2659 <br />The City Engineer is directed to prepare, an assessment roll showing the assessments <br />of benefits and the award of damages in the matter of the vacation of FIRST EAST -WEST <br />ALLEY SOUTH OF WASHINGTON AVENUE from the east line of 24th Street, east a distance of <br />588 feet to the east line of No. 25 in Tuxedo Park, First Addition and 42 in Tuxedo Park <br />2nd Addition of Lots in Jefferson Heights Addition <br />and <br />FIRST EAST-W`E'ST ALLEY SOUTH OF WILSON STREET from the east line of 24th Street, east a <br />distance of 588 feet to the east line of Lots No. 9 and 24 in Tuxedo Park, First Additio <br />of Lots in Jefferson Heights Addition. <br />U <br />• <br />• <br />• <br />0 <br />L "A <br />
