258 i VACATION RESOLUTION NO. 2671 f RESOLVED BY THE BOARD OF PUBLIC X RKS OF THE CITY OF SOUTH BEND, INDIANA: That it I is desirable to vacate the following; THAT PART OF EAST M ARION STREET BOUNDED AS FOLLOWS: Beginning at a point 201 feet east of the northwest cornerof Lot 130 in the original plat of South Bend; Thence north 15 feet; thence east parallel to the south line of Marion Street to the west line of the St. Joseph River; thence southwesterly along the west line of the St. Joseph River to the south line of Marion Street; thence west on the south line of i Marion Street 343.28 feet mor or less to the place of beginning, said 15 foot strip of East Marion Street being that part of said street lying north of the north pro- perty line of Lot 118 in the original plat of South Bend and a part of vacated St. Joseph Street immediately west thereof. The following property may be injuriously or beneficially effected by such vacation Lots numbered 1 to 6 inclusive, Hammond and4Wnitcomb Addition and j; Lot numbered 118 original plat of South Bend. Notice of this resolution shall be published on the 20th day of April and on ,the 27- day of April, 19%1, in the South Bend Daily Tribune and the Weekly Record. This Board, at its office in the City Hall on the 7th day of May, 1951, at 10:00 aom., C.S.T., will hear and receive remonstrances from all persons interested in or af- fected by these proceedings. Bruggner 2 T - 4/20 - 4/27 BOARD OF PUBLIC 4'O RKS & SAFETY VACATION RESOLUTION NO. 2659 This being the date set for the continued hearing on Vacation Resolution 2659 for the vacation of Marshall Street, comes now Leo P. Rieder, Attorney for the remonstrators who presents to the Board the following agreement: Board of Public Works City of South Bend South Bend, Indiana I We, .,the undersigned, sole owners of Lots Numbered 11, 12, 13 and 14 of Jefferson Heights Addition to the City of South Bend, Indiana, for value received, hereby agree j to dedicate to the City of South Bend a strip of land across part of said lots, sixty (60) feet in width, North and South and located at such a point as to constitute a con- !' tinuation of Marshall Street projected west, with a cul-de-sac on the west end of Marshail Street so projected west of a radius of approximately sixty-five (65) feet, all to be f' approved by the Board of Public Works of said City. We further agree to have the survey made and to perfect the said dedication within a period of ninety (90) days from date hereof. We also agree to release the City of South Bend from all damages by reason of the laying out and opening of said street.
