<br />IMPROVEMENT RESOLUTIONS
<br />Nos. 2661, 2662, 2663, 2668, 2669 & 2670
<br />South Bend, Indiana
<br />April 9, 1951
<br />Be It Resolved, By the Board of Public 'Works and Safety of the City of South Bend,
<br />Indiana, that it is deemed necessary to improve ALLEY BETWEEN ALTGELD AND VICTORIA STREE1.11S
<br />from the east line of Fellows Street to the west line of Alley west of Erskine Blvd., AN
<br />HIGH STREET from the north line of Donmoyer Avenue to the south line of Woodside Street,
<br />AND
<br />EDISON STREET from the south line of Ford Street to the north line of Sample Street,
<br />AND
<br />EAST DAYTON STREET from the east line of Vernon Street to the west line of Twyckenham
<br />DRIVE, AND
<br />LOMBARDY DRIVE from the south line of Sample Street to the north line of Meadow Lane,
<br />by -constructing Class "C" pavements, AND
<br />WEST 112 OF FELLOWS STREET from the south line of Sherwood Avenue to the James Monroe
<br />School by constructing grade, curb, walk and a Class "C" pavement.
<br />The same to be done in accordance with the profiles, drawings, plans, general de-
<br />•
<br />tails and specifications of such improvements approved April 9, 1951, and to be adopted
<br />by the Board of Public Works and Safety of the City of South Bend, immediately upon the
<br />final adoption of this resolution, and placed on file in the office of the City Civil
<br />Engineer of said City, and such improvements are now ordered.
<br />The total cost of said improvements, including all incidental costs such as adverti�i-
<br />ing, abstracting, inspection and engineering, shall be assessed upon the real eatate abg, -
<br />ting on said HIGH STREET; EDISON STREET;.EAST DAYTON STREET; LOMBARDY DRIVE; and WEST 1
<br />112 OF FELLOWS STREET to be improved, all according to the method and manner provided
<br />for in an Act of the General Assembly of the State of Indiana, entitled, "An Act Concern'
<br />ing Municipal Corporations" approved March 6th, 1905, and in accordance with and pursuant
<br />to the provisions of all amendatory and supplemental acts thereto, passed by the General;
<br />•
<br />Assembly of the State of Indiana. Assessments, if deferred, are to be paid in ten equal'!
<br />installments, with interest at the rate of six (6) per cent per annum. (A bond or bonds
<br />shall be issued to the contractor in payment of assessments, as the several owners of
<br />real estate upon which they are a lien exercise the right to pay the same in ten equal
<br />installments.) Under no circumstances shall the City of South Bend, Indiana, be or be j
<br />held responsible for any sum or sums due from said property owner or owners for said work-,
<br />or for certificate or certificates, bon or bonds, issued tos aid contractor in payment
<br />for such work, except for such moneys as shall have been actually received by the City
<br />from assessments for such improvements, or such moneys as the City is by said entitled,
<br />Act and the provisions of all Acts amendatory and supplemental thereto, required to pay.;l
<br />All proceedings had and work done in making of said improvements, assessments of propert,
<br />collection of assessments and issuance of bonds therefor, shall be for in
<br />•

<br />entitled Act and amendments thereto.
<br />The 2nd day of May, 1951, at the hours of 7:30 o'clock P.M.-C.S.T. is hereby fixed !
<br />as the time, and the office of the Board in said City as the place, when and where all
<br />persons whose property may be affected by such proposed improvements, may be heard as
<br />to the necessity for the same, and all petitions and remonstrances received and the Boa
<br />will, on said day, decide whether the benefits accruing to abutting and adjacent property*,
<br />and to the City of South Bend, Indiana, will be equal to or exceed the estimated cost ofi;
<br />said improvement. The Clerk of the Board is hereby ordered to give notice by two weekly;
<br />publications, of the time and place of hearing of this resolution.
