<br />the Board of Public Works and Safety of the City of South Bend, immediately upon the final'
<br />adoption of these resolutions, and placed on file in the office of the City Civil Engineer

<br />The total cost of said improvements, including all incidental costs such as advertis
<br />ing, abstracting, inspection and engineering, shall be assessed upon the real estate abut

<br />STREET to be improved, all according to the -method and manner provided for in an Act of
<br />Ithe General Assembly of the State of Indiana, entitled, "An Act Concerning Municipal Cor-
<br />1porations"
<br />approved March 6th, 1905, and in accordance with and pursuant to the provision
<br />,
<br />of all amendatory and supplemental acts thereto, passed by the General Assembly of the
<br />I
<br />1State of Indiana. Assessments, if deferred, are to be paid in ten equal installments, wi

<br />interest at the rate of six (6) per cent per annum. (A bond or bonds shall be issued to
<br />the contractor in payment of assessments, as the several owners of real estate upon which
<br />1
<br />they are a lien exercise the right to pay the same in ten equal installments.) Under no
<br />circumstances shall the City of South Bend, Indiana, be or be held responsible for any
<br />,sum or sums due from said property owner or owners for said work, or for certificate or
<br />!certificates, bond or bonds, issued to said contractor in payment for such work, except
<br />for such moneys as'shall have been actually received by the City from assessments for suc
<br />I •
<br />�imppovements, or such moneys as"the City is by said entitled Act and the provisions of all!
<br />lActs amendatory and supplemental thereto, required to pay. All proceedings had and work
<br />;done in makingof said improvements, assessment of property, collection of assessments and
<br />±atheretoe of bonds therefor, shall be as provided for in said entitled Act and amendments ��
<br />.
<br />The 30th day of August, 1950, at the hour of 6:30 o'clock PM -CST is hereby fixed as I� .
<br />the time, and the office of the Board in said City as the place, when and where all per- I
<br />sons whose property may be affected by such proposed improvements, may be heard as to the
<br />necessity for the same, and all petitions and remonstrances received and the Board will,
<br />ons aid day, decide whether the benefits accruing to abutting and adjacent property, and •
<br />to the City of South Bend, Indiana, will be equal to or exceed the estimated cost of said
<br />improvements. The Clerk of the Board is hereby ordered to give notice by two weekly pub-
<br />lications, of the time and place of hearing of these resolutions. j
