140 <br />A Maintenance Bond in the w.ount of $6,961.43 was approved and ordered filed for <br />the Reed Construction Company covering the pavement on Hoover Avenue from Twyckenhan. Ave <br />nue to Greenlawn Avenue. <br />A petition to vacate alley between Brookfield and Johnson Streets, from Lincolnway <br />!'West to Longley Street excepting the intersection of the north arld south alley was receive: <br />led by the Board and referred to the City Plan Commission for investigation and report. <br />j The Board approved plans for the widening, of Williams Street from Western Avenue to <br />;South Street and the Clerk of the Board was directed to advertise for bids for same, re- <br />lturnable on July 24, 1950. <br />y ;l This being the date set to receive bids for the construction of a sewer extension <br />;Ion EAST JEFFERSDN BOULEVARD, the following bid<was bpaned and publicly read: <br />INiles Excavating Compaz y <br />;R. R. #3 <br />,Niles, Michigan <br />A Non -Collusion Affidavit with <br />a Bid Bond in the sum of 5% of <br />the Bid accompanied the bid. <br />Item No. 11 5,400.00 <br />Item No. 2. 25.00 I <br />Item No. 3, 250.00 <br />TOTAL EXTENSION OF ITEMS 5,675.00 <br />This being the only bid received, it was accepted by the Board. <br />Mr. Thomas R. Luce, 1101 Campeau Street, appeared before the Board to ask permission; <br />to reopen the South Bend Avenue Dump, stating that he was willing to operate the dump I! <br />according to all rules and regulations set forth by the Board. Permission was held up <br />pending discussion before the Common,Council. <br />Vacation Resolutioh.No. 2639 <br />This being the date set, hearing was held on the assessment roll showing the award <br />of damages and the assessment of benefits in the matter of vacation of WOODSIDE STREET <br />beginning at the northeast corner of Lot 175, Ridgedale 4th Addition; thence southeaster- <br />ly along the southerly line of Woodside Street a distance of 100 feet; thence northwester <br />ly a distance of 83.28 feet to the southeasterly corner of Lot 177; thence northwesterly <br />along the northeasterly line of said Woodside Street a distance of 78.59 feet to a point <br />opposite place of beginning; thence southwesterly a distance of 80 feet to the place of <br />beginning. All in Ridgedale Fourth Addition, South Bend, St. Joseph County, Indiana, I' <br />under Vacation Resolution No. 2639. <br />In the above named assessment roll, no remonstrators appeared and no written remon- <br />strances were filed, the Clerk of the Board submitted proofs of publication of notices and <br />same were found sufficient, and the Board, therefore, finds that the several lots and part <br />cels of land have been benefited and damaged in the amounts shown on said roll. The Board, <br />therefore, decides to take final action on said assessment roll and declares same in all ' <br />things ratified, confirmed and approved without modifications and the proceedings closed,', <br />and the portion of the street vacated upon receipt of the amount of benefit assessments j <br />from the various property owners so benefited and all proceedings had with referenpe to <br />said street vacation are hereby sustained. <br />Vacation Resolution No. 2641 <br />This being the date set, hearing was had on the resolution heretofore adopted by the <br />Board of Public Works for the vacation of the alley lying immediately north of lot #11 <br />extending from St. Peter Street to the west line of said lot and the alley between Lots <br />#4 and #5 extending from Howard Street to the south line of said lots in Kelleyts Sub -Di- <br />vision of Lots #131,132,133,137,138 and 139 in Sorints Second Addition to the town of <br />Lowell now a part of South Bend, Indiana, under Vacation Resolution No. 2641. The Clerk <br />of the Board having shown sufficient proofs of publication of notices and no remonstra- <br />tors having appeared and no written remonstrances having been filed with the Clerk, it <br />was moved, seconded and unanimously carried that the said resolution be finally adopted <br />and the said alleys be vacated subject to an easement granted to the Indiana and Michigan <br />Electric Company in the alleys proposed to be vacated be preserved as they now exist. <br />The Engineering Department is directed to prepare an assessment roll covering the assess- <br />ment of benefits and the award of damages to the surrounding properties. <br />CONTRACTORS COMPLETION AFFIDAVIT <br />STATE OF INDIANA ) <br />) SS: <br />ST.
