RE <br />' Therefore Be It Resolved, By the Board of Public Works and Safety of the City of <br />South Bend, Indiana. that the bids of Niles Excavating Company, Niles, Michigan for the ! <br />( construction of the improvements described in Improvement Resolutions Nos, 2636, 2631, <br />:I and 2632, 1950 passed by this Board on April 24, 1950,a.nd confirmed by this Board on Mayi. <br />9, 1950 be and the same is hereby accepted and that the City of South Bendy Indiana. thru i' <br />its Mayor and Board of Public Works and Safety enter into a written contract with said <br />Niles Excavating Company for the faithful execution of such work, according to said bids, <br />the detailed plans and specifications and the terms of said Resolutions, provided that <br />• before entering upon the performance of said,contracts7 said Niles Excavating Company, <br />Niles, Michigan shall give bonds, in the amount equal to one hundred (100) per cent of <br />the contract price for such work, with a Surety Company legally authorized to transact i <br />business in the State of Indiana, as Surety,.to the approval of this Board, to secure <br />the performance of such contracts, and to hold the City of South Bend, Indiana, harmless! <br />from payment of any debt or damage by reason.of any act of such Contractor, and to secure, <br />the payment of all claims for labor and material used in such improvements, <br />R. Bruggner was absent. The meeting was called for the purpose of <br />public hearings on Improvement Resolutions: <br />i No. 2623 GLADSTONE AVENUE from Ford Street to Sample Street <br />. No. 2621+ CHICAGO STREET from Western Avenue to Ford Street <br />No. 2625 KENMORE STREET from Western Avenue to Ford Street <br />No. 2628 ALLEY BETWEEN MCKINLEY AVENUE AND LASALLE AVENUE to the west line of <br />Esther Street <br />No. 2629 VASSAR AVENUE from the east line of Wilbur Street to the east line of <br />Lawndale Avenue <br />Property owners whose property is effected by the above resolutions will have a ten <br />(1Q) day period in which to file remonstrances against the improvement resolutions. <br />J ATTEST:: <br />BOARD PUBLIC eft=�aSAFETY <br />
