• <br />IMPR0VL ,1TE N,11 T H17iSOLUTIOET NO. 2580, 1948 <br />South Bend, Indiana <br />Septe��ber 71 1948 <br />Be It Resolved, By the Board of Public Works and Safety of the City of South <br />Bend, Indiana, that it is deemed necessary to improve Sibley Avenue from West line of <br />Wilber Street to east line of College Street by dra.ining, grading and paving the roa.d- <br />inra,y with a, Class C pavement, Type 1: Portland Cement Concrete; Type 2 - Bituminous <br />Compacted Aggregate Base, Bituminous Concrete Surface; Type 3 - Bituminous Compacted <br />gI� et e Base BituminousCoa.� ed Aggregate Surface, Type Com acted Ag ;re -ate Base <br />11 <br />, <br />� , <br />Bituminous Concrete Surface; Type 5 - Compacted Aggregate Sa,se, Litur:iinous Coated Aggre- <br />gate Surface. The same to be done in accordance with the profiles, drm,rings, plans, <br />general details and specifications of such improvement adopted on September 7, 1948 <br />and to be adopted by the Board of Public Works and Safety of the City of South Bend, imm <br />upon the final adoption of this resolution, and placed on file in the office of the City <br />Civil Engineer of said City, and such -improven-ient is now ordered, <br />The total cost of said improvement? including all incidental costs such as <br />advertising, abstracting., inspection and engineering, shall be assessed upon the real <br />estate abutting on said Sibley Avenue to beimproved, all- according to the method and <br />manner provided for in -an Act of Ithe General Assembly of the State of,indiana, entitled <br />"An Act Concerning 1lunicipal Corporations" approved_!�ia.rch 6 1905, and in accordance <br />with and pursuant to the provisions of all amendatory and supplemental acts thereto, <br />passed by the General Assembly of .the State of India.na,. Assessrnents, if deferred, are t <br />be,paid in ten equal installments with interest at the rate of five (5) percent per <br />a.nnum. (A bond or bonds shall be issued to the contractor in payment of assessments, as <br />the several owners of real estate upon which they are a lien exercise the right to.pay, <br />the same in ten equal installments. ) Under no ci-rcumsta.nces shall the City of South, <br />Bend, Indiana,, be or be held responsible for any sum or sume due from said property <br />owner or of%.mers for said work, or for certificate or certificates, bond_ or bonds, issued <br />to said contractor in payment for such work, except for such moneys as shall have been <br />actually received by the City from Assessment for such improvement, or such moneys as <br />the City is by said entitled Act the the provisions of all Acts amendatory and supple- <br />mental thereto, required to pay. All proceedings had and t•ro rig done in making of said <br />improvement, assessment of property, collection of assessr:ient of property, collection <br />of assessments af and issuance of bonds therefore; shall be as -crovided for in said entitle <br />Act and amendments thereto. <br />September 30, 1948 at the hour of 7:30 o'clock.
