<br />Be It Resolved, By the Board of Public Works and Safety of the City of South �
<br />Bend, Ird Tana, that it is deemed necessary to improve E-1 ldreth Street from 1,%lest line
<br />of Greenla.zm Avenue to the West line of Alley ,lest of Greenlaaz.,m Avenue by draining,
<br />grading and paving the roadway with a Class C Type 1 - Portland Cement Concrete; Type 2
<br />Bituminous Coripa.eted Aggregate Base, Bituminous Concrete Surface; Type 3 - Bituminous
<br />Cor_pacted Aggreate Base,,Bituminous Coated Aggregate Surface; Type 4'- Cor_pacted Aggre-
<br />gate Base, Bituminous Concrete Surface; Type 5 - Compacted Aggregate Base, BitLirni_nous ii
<br />Coated Aggregate Surface pavement. The same to be done in accordance with the profiles,

<br />30, 194d and to be adopted by the Board of Public ,lorks and Safety of the City of South
<br />Bend, ir_imedi atel;r upon the fi na.1 adoption of this -resolution, and placed on file in the
<br />office of the City Civil Engineer of said City, and such improvement is now ordered. i
<br />The total cost of said improvement, including all incidental costs such as adver- i)
<br />tising, abstracting,�inspection and engineering, shall be assessed upon the real estate
<br />.butting on said Hildreth Street to be improved, all according to the method and r,anner
<br />provided for in an Act of the General Assembly of the State of Indiana., entitled, "An
<br />Act Concerning Municipal Corporation." approved M arch Gth, 1905, and in accordance wi thil
<br />and pursuant to the provisions of all ax_=datory and supplemental acts thereto, passed !!
<br />by the General Assembly of the State of Indiana. Asscssr_ents, if deferred, are to be
<br />paid in ten equal installments with in' --.crest at the rate of five (5) per cent per an:ouxn.'!
<br />(A bond or bonds shall be issued to the contractor in payment of assessments, as the
<br />several owners of real estate upon which they are a lien exercise the right to pay the !i
<br />same in ten equal installments.) Under no circum_stanccs shall the City of South Bend,
<br />Indiana , be or be held responsible for any sulii or sums due from said propert;,r owner j
<br />or owners for said work, or for certificate or certificates, bond or bonds, issued to
<br />said contractor in payment for such :vrork, except for such moneys as shall have been
<br />actually received by the City from assess�:.ent for such improvement, or such moneys as
<br />the City is by said entitled Act and the provisions of all !_cts amendatory and supple-
<br />mental thereto, required to pay. All proceedin,;s had and wore done in making of said
<br />improvement, assessment of ,property, collection of assessments and issuance of bonds 1!

<br />Thi;s� being the date set, hearing was had on the resolution heretofore adopted by '
<br />the Board of Public Works for the vacation of Iowa. Street between Ford and Dunham StreetCD

<br />except therefrom, so much of said part of Io"M Street as lies within the dedication of
<br />Vermont Place by the SUpplerental Plat of Belleville 2nd Unit, covering bloc Ts "Cl? �rDi►�I
<br />►r]'rr, and 'IF" thereof, under Vacation Iesolution - o. 2577. The Clerk of the Board having;)
<br />shown sufficient proofs of publication and no remo_lstrators having appeased and no
<br />written remonstrances having been filed with the Clem-_, it was :loved, seconded and unan-11
<br />imously carried that the said resolution be finally adopted and tl-re said street be
<br />vacated. The Engineering Department is directed to prepare an assessment roll covering
<br />the assessment of benefits and the award of dalr<a CD
<br />ges to the surrounding properties.
<br />The Board now proceeds to a,rard damages sustained and to assess Uflc benefits aceru

<br />The Board now finds that no piece of property on the above list will be injuriously
<br />or beneficially effected by the vacation of the above street.
