278 <br />GARBAGE DISPOSAL: The follovring paragraph was approved by the Board to be a part of <br />e specifications for the garbage contract. The Boa,rd finds that it is to the benefit <br />of the bidders and it is unnecessary to notify them of sane: <br />"Non-performance by the contractor caused by strikes shall not be deemed a breach eithe <br />of this contract or of the performance bond but the city shall not pay the contractor <br />the compensation accruing to"the contractor for any such period of non-performance so <br />caused by strifes nor collect from it the cost of any collection of garbage made by the <br />city during such period and, if the period of non-perfor=aance caused by strikes shall <br />exceed fourteen (14) days, the city may, at its election, cancel and terminate this con <br />tract by Smitten notice to the contractor." <br />This being the date set, the following bids were received, opened and publicly <br />read for the collection and disposal of garba3e: <br />Palmer Cartage Company, A certified check in the amount <br />South Bend, Indiana of500.00, <br />Bid on alternate „L1 for the collection and disposal <br />of garbage for the year 1947 ;691706.90 <br />T;elvin J. Summers <br />North Liberty, Indiarm a Certified check in the ammount of <br />500.00 <br />Bid on Alternate „'5 for the years 1947-1948 and <br />1940 Total `1991024.72 <br />Bid on alternate ,`7 for the years 1947-1948 and <br />1949 Total L;1991024.72 <br />The Board took the bids under advisement and the ward grill be made at a later date. <br />ENGINEERIFIG DI EPART TENT• Contractor's bonds in the amount of ; 1,000.00 each -aere <br />approve an orrereci-filed for John C. VonBergen andJoseph Udvardi. <br />This being the date set, the follo,ring bids were received, opened and publicly <br />read: For the Paving of Hamilton Street from Portage to Brookfield Street. <br />Rieth.-Riley Construction Company, Acco_-apanied by a certified <br />Goshen, Indiana check in the'amount of 800,00 <br />also anon -collusion affidavit <br />771 gravel base construction and 21T Asphaltic Concrete (A ) resurface over gravel <br />and brick base :;?6..475.00 <br />Reed Construction Corlpany, Acco -oanied by a certified check <br />Tlishawaka, Indiana in the amount of ?873.00- also a <br />non -collusion affidavit <br />Bid was on 1-2-3 plain concrete 8,729.50 <br />1,Tr. Andrysiak moved that the bid of the Rieth-Riley Construction Company, be <br />accepted as it was, in the Boar_IT s opinion, the lowest and best bid submitted, TTr. <br />Cix.aiings seconded the motion and it was unanimously carried. <br />Yr. Levy moved that the Engineering Department be directed to prepare and file <br />an assessment roll on the Hamilton Street Improvement on or before October 21, 1946. <br />This being the date set for receiving bids on the test borings for the Interceptor <br />Sewer, the f ollo ring bids were opened and read: <br />Layne-lyorthern C'ampany, Bidder's bond accompanied the bid as well as a non -collusion <br />TTishawaka, Indiana affidavit. <br />Total bid was in the amount of 3 ,818.00 vri t'-a an additional <br />charge of 114.25 Der foot for plus or minus depths. <br />B. J. Moore & Son, Certified check in the amount of T325.75 accompanied the bid <br />Elkhart, Indiana and also a non -collusion affidavit. <br />Total bid was in the amount of 3,527.50 with a plus or <br />minus charge of :J3.75 per foot. <br />T � Board accepted the bid of the B.
