244 Vacation Resolution No. 2546 The Board of Public -works and Safety of the City of South Bend, met, pursuant to notice given as required by law, to hear remonstrm ces and to take final action on Declaratory Resolution No. 2546, 1946, by which resolution the Board resolved that it is desired and deeded necessary to vacate the following described street and alleys in the City of SoLt h Bend, St. Joseph County, Indiana: (a) Sycamore Street north of LaSalle avenue; (b) The first alley running :last and }lest from Sycamore Street to the East Race, which said alley is the first alley North of and parallel to LaSalle Avenue; (c) The first alley East of Sycamore Street running North and South from LaSalle Avenue to the first east and west alley North of LaSalle Avenue. No remonstrm ces being filed with or presented to the Board against said proposed vacation, thereup6n, being duly advised intee matter, the Board now takes final action on said original resolution. On motion duly made, seconded and unanimously carried it is RESOLVED that said Declaratory Resolution No. 2546, 1946, be and the same is hereby in all things approved, ratified and confirmed with out modification; FURT-T IR RESOLVED, that the above described street and alleys be and the same are hereby declared vacated; FURTLIER RESOLVED , that there be forthwith prepared a list or roll of all the owners or holders of property, and of all interest therein, injuriously or beneficially affected by such vacation. The following is a list of all the owners or holders of property, and of all inter- est therein, injuriously or beneficially affected b.,:,the vacation of said street and alleys: Chicago South Shore and South Bend Railroad is owner of the following described real estate in St. Joseph County, Indiana: (a). Lots Nizabered consecutively from TVTenty-two (22) to Twenty-nine (29), both inclusive, as shown on the Recorded Plat of TIiller and Greents Second Addition to the Town of Lowell, now a part of the City of South rend; (b) Lots numbered Ten (10), Eleven (11) and "Welve (12) as shown on the Original Plat of the Town of Lowell, now a part of the City fo South Bend, except; (1) A tract of land bounded by a line running as follows: Beginning at the Southwest corner of said Lot Nizabered Twelve (12), thence East 66 feet, thence North 60 feet, thence :'lest 66 feet, thence South on the ;`lest line of Sycamore Street 60 feet to the place of begi.nning; (2) A tract of land bounded by a line running as follows: Beginning at a point on the North line of LaSalle Avenue 321.04 feet East of the East of Sycamore Street, thence ISorth 128.5 feet to the ':lest bank of the East Race, thence Southeasterly along said bank to the North line of LaSalle Avenue, thence ':Zest 58.2 feet to the place of beginning. Samuel R. Feuer is the owner of the following described real estate in St. Joseph County, Indiana: A, part of Lot NLanbered Twelve (12) as shown on the Original Plat of the Town of Lowell now a part of the City of South. Bend bounded by a line running as follows: Beginning at the Southwest corner of said lot Numbered Twelve (12), thence East 66 feet,.thence North 60 feet, thence `,lest 66 feet, thence South on the 17est line of Sycamore Street 60 feet to the place of beginning. The Board now proceeds to award damages sustained and to assess the benefits accruing; to each piece of property on the foregoing list. The Board now finds that no piece of property on the foregoing list will be in- Juriously or benficially affected by the vacation of said street and alleys. And now comes Samuel Feuer and.
