Martin, Clerk <br />Board of Public Works <br />FROM: Kara Boyles, City Engineer <br />SUBJECT: Charles Black Center Renovation Project <br />Project No. 116-073 <br />DATE: September 19, 2017 <br />On September 12 2017, the Board of Public Works opened and read bids for the above project. Ziolkowski Construction, Inc. <br />Not Complete <br />$ 166,000.00 <br />$ 19,500.00 <br />The Division of Engineering has reviewed all of the bids and noted the following discrepancy. The <br />Ziolkowski Construction, Inc. bid submission did not include an itemized price for the Soil Management <br />Plan. Per Special Provisions XL _. Removal of Contaminated Soils, "the Contractor shall adhere to <br />the Soil Management Plan prepared by WSP for all site earthwork and utility installation and that <br />all work associated with the requirement shall be included in the Soil Management Plan lump sun <br />item". In addition, Part 1 — General Clarifications, Item 11 of Addendum #3, dated September 5, <br />2017, it states "The final Soil management plan; is attached and is to be included in contract bid as <br />an itemized price". Upon further review and in conversation with Bill Favors, a representative of <br />Ziolkowski Construction, Inc., he stated that "they felt there were too many variables and potential <br />liabilities related to the existing soils and the Management Plan, didn't feel comfortable being <br />responsible for this work, and, therefore, did not include that portion of the project in their bid." <br />Based on this information, and further review by the Board's Legal Counsel, I recommend that <br />Ziolkowski Construction, Inc. be deemed a non -responsive bidder. <br />The Division of Engineering therefore recommends that the Board award the Base Bid, Soil Management <br />Plan, Alternate 8 and Alternate 9 to the lowest responsive/responsible bidder, Gibson -Lewis LLC, in the <br />amount of $3,796,000.00. <br />Sufficient funds have been appropriated through two funding sources: RWDA TIF, Fund No. 324-1050- <br />460-42.02 2 296 000 and the Park Bond Fund No. 751-1101-452-39.89 1 500 000 . <br />Please call with your questions.
