ZONING AND ANNEXATION COMMITTEE 11-23-09 <br />Al "Buddy" Kirsits, Chairperson, Zoning and Annexation Committee called the meeting <br />to order at 4:00 p.m. <br />Committee Members Present: Tom LaFountain, Oliver Davis, David Varner <br />Other Councilmember's Present: Henry Davis, Jr., Tim Rouse, Ann Puzzello <br />Other's Present: Bill Schalliol, Christian Davey, Mikki Dobski-Shidler, Tom Price, Todd <br />Zeiger, Elicia Dadlow, Assistant Director Historic Preservation Commission <br />Agenda: Bill No. 57-09 -Rezone - 616 N. St. Peter <br />Bill No. 09-60 -Special Exception - 616 N. St. Peter <br />Bill No. 09-71-Special Exception - 4050 Ralph Jones Drive <br />Bill No. 90-09 -Historic Landmark - 501 W. Washington <br />Chairperson Kirsits began the hearing by stating the petitioner for Bill Nos. 57-09 and <br />09-60 had requested a continuance until the next meeting on December 14, 2009. All <br />agreed and the continuance was granted. <br />Bill No. 09-71 requests a special exception for Ziolkowski Construction to allow for a <br />storage yard in an office park area. Mark Lyons from the Building Department reported a <br />no recommendation had been forwarded from the BZA. Mike Danch made the <br />presentation for the petitioner. He was assisted by Christian Davey of Grubb & Ellis <br />Commercial Real Estate. They both emphasized the need for outside storage of <br />equipment. Mr. Danch reported that based upon concerns of nearby businesses voiced at <br />the BZA hearing the petitioner had agreed to screening provisions, namely, mounding <br />and 30 additional evergreens. Councilmember Ann Puzzello said she visited the site and <br />would support the petition. Councilmember Oliver Davis also visited the site and voiced <br />support with the additional screening. Councilmember Kirsits read two letters of support <br />from adjacent businesses. On a motion to recommend favorably by Councilmember <br />Oliver Davis, followed by a second from Councilmember Varner a vote was taken and <br />supported by all. <br />Bill No. 90-09 would designate the Rushton Apartments at 501 W. Washington a Historic <br />Landmark. Todd Zieger of the Historic Landmarks of Indiana spoke to the significance <br />of the building. Councilmember Henry Davis asked how a building vacant for seven (7) <br />years could entice a developer to turn it into atax-paying entity. Zeiger said a developer <br />already spent over $1,025,000 to replace the roof. He went on to declare the 20 units in <br />the building as being very developable.
