FIRST AMENDMENT TO AGREEMENT FOR PROGRAMS AND SERVICES WITH CITY OF SOUTH BEND DEPARTMENT OF CODE ENFORCEMENT (DEMOLITION OF BLIGHTED HOUSES) NEIGHBORHOOD STABILIZATION PROGRAM I (NSP1) CONTRACT #15-JO-74 THIS AMENDMENT to the 2015 NSP Agreement for Programs and Services tlghe City of outlt Bend De ailment of Code Enforcement dated March 10, 2015 is entered into this day of �1 ' , 2017, by and between the City of South Bend, State of Indiana, by and through its Board of Public Works for and on behalf of the Department of Community Investment (the "City") and the City of South Bend Department of Code Enforcement (the "Agency"). WHEREAS, City and Agency are parties to an agreement entitled "Agreement for Programs and Services" dated March 10, 2015 made effective January 1, 2015 ("NSP Agreement"); and WHEREAS, this agreement is entered into as the First Amendment to the NSP Contract to modify certain terms and conditions expressed in the NSP Contract; and NOW, THEREFORE, in consideration of the mutual promises and obligations set forth herein, the parties make this Amendment to the NSP Contract as follows: (1) Appendix I TIMETABLE Costs may be incurred when the agency is notified to proceed by the Department of Community Investment. This activity shall commence on January 1, 2015, and shall continue to December 31, 2017. All funds unobligated by December 31, 2017 and all funds unspent by January 31, 2018 will be recaptured by and reallocated by HUD. (2) Appendix II BUDGET The total budget of Code Enforcement Demolition Project (1540-14) shall not exceed $403,405.00. (3) Each and every other provision of the original NSP Contract and the attachments thereto are hereby ratified, approved and reaffirmed by the parties and all other matters previously agreed to and set forth in the original NSP Contract and not affected by this Amendment shall remain in full force and effect. (4) This Amendment may be executed in multiple counterparts, each of which shall be deemed an original.
