This is EXHIBIT G, consisting of 3 pages, referred to in <br />and part of the Agreement between Owner and Engineer <br />for Professional Services dated Jules, 2017. <br />Insurance <br />Paragraph 6.04 of the Agreement is supplemented to include the following agreement of the parties. <br />G6.04 Insurance <br />A. The limits of liability for the insurance required by Paragraph 6.04.A and 6.043 of the Agreement <br />are as follows: <br />See page 3 of Exhibit G. <br />1. By Owner: <br />a. The City of South Bend is a municipal corporation organized under the laws of the State <br />of Indiana, and is self -insured under provisions of Indiana statutes and local ordinance. <br />Specifically, the City of South Bend maintains blanket insurance coverage over real and <br />personal property, and is covered by a non -reverting insurance premium and liability <br />reserve fund created by the City of South Bend, Ordinance #6657-79, pursuant to <br />Indiana Code 34-13-3-4, as amended from time to time. Under said statute, the City's <br />liability is limited to: <br />1) Seven hundred thousand dollars ($700,000) for a cause of action that accrues on or <br />after January 1, 2008; and <br />2) Five million dollars ($5,000,000) for injury to or death of all persons in that <br />occurrence, and <br />3) A governmental entity or an employee of a governmental entity acting within the <br />scope of employment is not liable for punitive damages, <br />B. Additional Insureds: <br />1.
