RESOLUTION NO, 24-2017 A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND ACCEPTING THE ASSIGNMENT OF TAX SALE CERTIFICATES FROM THE ST. JOSEPH COUNTY BOARD OF COMMISSIONERS WHEREAS, the City of South Bend, Indiana, Board of Public Works (the "City Board") has custody of real property owned by the City of South Bend, Indiana (the "City") pursuant to IC 36-9-6-3; and WHEREAS, pursuant to IC 6-1.1-24-6 and IC 6-1.1-24-9, the St. Joseph County Board of Commissioners (the "County Board") holds a tax sale certificate for each of the thirty (30) parcels described in attached Exhibit A (collectively, the "Certificates"); and WHEREAS, IC 6-1.1-24-9(d) provides that, subject to IC 36-1-11-8, the County Board may assign the Certificates to the City Board; and WHEREAS, IC 36-1-11-8 provides that the County Board's assignment of the Certificates to the City Board may be made upon terms agreed upon by the County Board and the City Board as evidenced by their adoption of substantially identical resolutions; and WHEREAS, the County Board has adopted or is expected to adopt a resolution pursuant to IC 36-1-11-8 assigning the Certificates to the City Board for no consideration; and WHEREAS, the City Board desires to accept the County Board's assignment of the Certificates and thereafter to complete the legal procedures necessary to acquire fee simple ownership of the parcels described in the Certificates; and NOW, THEREFORE,, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND AS FOLLOWS: I . The City Board approves and accepts the County Board's assignment of the Certificates pursuant to IC 6-1,1-24-9�d). 2, The City Board authorizes David Relos of the City's Department of Community Investment to act on behalf of the City Board in taking any necessary and lawful actions to accept the Certificates fi-om the County Board and otherwise to accomplish the purposes of this Resolution. This Resolution will be in full force and effect upon its adoption. [Signature page follows.]
