RESOLUTION NO. 'NLII�_ <br /> RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br /> BEND,INDIANA,APPROVING LEASE OF BUILDING LOCATED AT 523 <br /> EAST JEFFERSON BLVD. <br /> WHEREAS,the City of South Bend("City") wishes to extend its current lease of <br /> a building located at 523 East Jefferson Boulevard, South Bend, IN 46617 ("Property") <br /> owned by Shein Realty, LLC ("Landlord"); and <br /> WHEREAS,the City currently leases the Property for shared use by the South <br /> Bend Police Department ("Police Department") and the Bureau of Alcohol, Tobacco, <br /> Firearms and Explosives (the "ATF") with the lease cost fully reimbursable by the ATF; <br /> and <br /> WHEREAS,the ATF reimburses the City for the rental payments made by the <br /> City to the Landlord; and <br /> WHEREAS,the City seeks to renew its lease of the Property for a term of one <br /> year with the possibility for renewal; and <br /> WHEREAS,the Board of Public Works will hold a public hearing with respect to <br /> the appropriateness of the proposed lease at its June 8, 2017 meeting; and <br /> WHEREAS,pursuant to I.C. § 36-1-10-7,the City instructed its Police <br /> Department to collect signatures from fifty (50) City residents within the neighborhood of <br /> the Property indicating their support of the lease of the Property. Said petition is attached <br /> hereto as Exhibit A and incorporated herein; and <br /> WHEREAS,pursuant to I.C. § 36-1-10-7, the Common Council must determine <br /> that the structure is needed and approve said lease of the Property. <br /> NOW, THEREFORE,BE IT RESOLVED by the Common Council of the City <br /> of South Bend, Indiana, as follows: <br /> 1. The Common Council deems it necessary for the City,through its Police <br /> Department, to renew its lease of the Property located at 523 East Jefferson Blvd. for <br /> shared use by the City and the ATF. <br /> 2. The City of South Bend is hereby authorized to renew its lease of the <br /> Property. <br /> ADOPTED at a meeting of the Common Council of the City of South Bend, <br /> Indiana held on , 2017, at the County-City Building, 227 West Jefferson <br /> Boulevard, South B end, Indiana 46601. <br /> 1 <br />
