8. Joint Study <br />The parties hereto agree to conduct a joint study to determine the overall capacity of the City's <br />wastewater utility that provides services to the Service Area and adjacent areas in western St, <br />Joseph County and ensure that the future developmental sanitary needs of the Service Area can be <br />met. The joint study will provide information on the capacity and condition of the sewer lines <br />located in western St. Joseph County, including but not limited to, the line commonly referred to <br />as the I/N Tek and UN Kote sanitary sewer line. The joint study will also address potential <br />alternatives for adding capacity to western St. Joseph County. <br />The County, with the consent of the City, shall select a consultant to perform the joint study. <br />The parties hereto shall mutually agree on the payment portion of the joint study after receiving <br />the estimate from the selected consultant. <br />9. Service Area Sewer Line Improvements <br />Should a capacity limitation in the sewer main line extending to the City's wastewater <br />treatment plant occur as a result of any connection made from the Service Area, the parties agree <br />to work together to resolve this issue before additional connections are made. <br />10. Maintenance Bond <br />County agrees to provide the City with a maintenance bond covering all work performed by <br />the County pursuant to this Agreement and such bond shall remain in effect for three (3) years <br />after dedication as described in Section 7 above. A copy of the maintenance bond is attached <br />hereto as Exhibit D. <br />11. Indemnification <br />
