<br />hereafter called the Principal and

<br />hereafter called the Surety, are held and firmly bound unto the Board of Commissioners, St, Joseph County, Indiana, and the
<br />Civil City of South Bend, Indiana, hereinafter called the Commission, in the amount of 10 percent of the contract bid amount
<br />for the sanitary sewer and applicable lump sum items which is the penal sum of Two Hundred Nineteen Thousand, Eight
<br />Hundred Twenty -Five and No Cents [$219,825A01_ for payment of which, well and truly to be made, we hereby jointly
<br />and severally bind ourselves, our heirs, executors, administrators, successors, and assigns.
<br />THE CONDITION OF THE ABOVE OBLIGATION IS SUCH, that whereas the above Principal did on this day, _August 2,
<br />2016, enters into a contract with the Commission for Project Description: R&S 91601f2-1: NEW CARLISLE
<br />DEVELOPMENT AREA --- WATER & SEWER IMPROVEMENTS which said contract is made a part of this Bond the
<br />same as though set forth herein.
<br />NOW, THEREFORE, if the said Principal shall well and faithfully do and perform the things agreed by him to be done and
<br />performed according to the terms of said contract, and shall pay all lawful claims of subcontractors, materials, men and
<br />laborers, for labor performed and materials furnished in the carrying forward, performing or completing of said contract, and
<br />furthermore warranting and guaranteeing the workmanship and material in this improvements for a period of time established
<br />herein, for a period of three (3) years from the date of final acceptance, and as provided in the contract, we agreeing, and
<br />assenting that this undertaking shall be for the benefit of any material, man or laborer having a just claim as well as for the
<br />obligee herein, then this obligation shall be void, otherwise the same shall remain in full force and effect; it being expressly
<br />understood and agreed that the liability of the surety for any and all claims hereunder shall in no event exceed the penal
<br />amount of this obligation as herein stated.
<br />The said Surety, for value received, hereby stipulates and agrees that no change, extension oftime, alteration or addition to
<br />the terms of the contract or the work to be performed hereunder or the specifications accompanying the same shall in any way
<br />affect its obligation on this bond, an it does hereby waive notice of any such change, extension of time, alteration or addition
<br />to the terms of the contract or to the work or to the specifications.
