<br />hereafter called the Principal and
<br />Merchants Bonding Company (Mutual), 6700 Westown Parkway, West Des Moines, Iowa, 50266
<br />(Surety Company Name & Address)
<br />hereafter called the Surety, are held and firmly bound unto the Board of Commissioners, St. Joseph County, Indiana,
<br />hereinafter called the Commission, in the amount of 100 percent of the contract bid amount which is the penal sum of _Four
<br />Million, Three Hundred Forty Eight Thousand, Three Hundred seventy Bight and twelve cents [$4,348,378A21 for
<br />payment of which, well and truly to be made, we hereby jointly and severally bind ourselves, our heirs, executors,
<br />administrators, successors, and assigns.
<br />THE CONDITION OF THE ABOVE OBLIGATION IS SUCH, that whereas the above Principal did on this day, _2"d of
<br />August, 2016_, enters into a contract with the Commission for Project Description: R&S 9160172-1: NEW CARLISLE
<br />DEVELOPMENT AREA -- WATER & SEWER IMPROVEMENTS which said contract is made a part of this Bond the
<br />same as though set forth herein.
<br />NOW, THEREFORE, if the said Principal shall well and faithfully do and perform the things agreed by him to be done and
<br />performed according to the terms of said contract, and shall pay all lawful claims of subcontractors, and their successors and
<br />assigns, materials, men and laborers, for labor performed and materials furnished in the carrying forward, performing or
<br />completing of said contract. This Payment Bond is for the benefit of the subcontractors, laborers, material suppliers, and
<br />those performing services and we agreeing, and assenting that this undertaking shall be for the benefit of any material, man or
<br />laborer having a just claim as well as for the obligee herein, then this obligation shall be void, otherwise the same shall
<br />remain in full force and effect; it being expressly understood and agreed that the liability of the surety for any and all claims
<br />hereunder shall in no event exceed the penal amount of this obligation as herein stated.
<br />The said Surety, for value received, hereby stipulates and agrees that any modification, omission, change, extension of time,
<br />alteration or addition to the terms of the contract or the work to be performed hereunder or the plans, drawings, and
<br />specifications accompanying the same; or defect in the public work contract; or a defect in the proceedings preliminary to the
<br />letting and awarding of the public works contract does not discharge the Surety and shall in any way affect its obligation on
<br />this bond, an it does hereby waive notice of any such change, extension of time, alteration or addition to the terms of the
<br />Contract or to the work or to the specifications.
