SPECIAL MEETING <br />APRIL 28, 2017 127 <br />2. Future utilities that need to occupy the City of South Bend right-of-way, excluding pre- <br />existing alleyways, shall be located underground <br />3. The construction of a new aboveground utility pole or a wireless support structure within <br />the City. of South Bend right-of-way shall require a waiver from the Board of Public Works, <br />however, this Resolution No. 17-2017 shall in no way prohibit or restrict the collocation <br />of wireless technology support structures on current utility poles or the replacement of <br />current utility poles or wireless support structures. <br />4. Martin, Clerk <br />PRIVILEGE OF THE FLOOR <br />Ms. Kathleen Bergan informed the Board that she is the resident Mr. Parrott from the South Bend <br />Tribune wrote about in the newspaper. She said she came to the meeting because she wasn't sure <br />if this was going to be a blanket exception, it was a little unclear. She noted the Leeper Park Area <br />is already like a power plant, adding it seems AT&T has over —saturated the area. She stated she <br />didn't know if the City was going to cover a blanket area and she wanted to make sure Harter <br />Heights and Leeper Area are included in the area. Attorney Schmidt stated the Board doesn't have <br />the authority to prevent the replacement of what is already there, they just want to make sure an <br />area doesn't get saturated. Ms. Bergan stated she understands that, adding it's an area that's already <br />saturated. Mr. Horvath stated they wanted to be all -expansive. Ms. Bergan agreed that is a really <br />good idea. She noted a cooling box was placed near her home that doesn't comply with any decibel <br />restrictions and she has concerns with the health effects and the stress of the noise disruption that <br />never stops. <br />ADJOURNMENT <br />There being no further business to come before the Board, upon a motion made by Mr. Mueller, <br />seconded by Ms. Fritzberg and carried, the meeting adjourned at 3:18 p.m. <br />BOARD OF PUBLIC WORKS <br />Gary A.
