ORDINANCE NO. ~ ~ ~ A <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA, AMENDING THE ZONING ORDINANCE AND <br />ESTABLISHING HISTORIC LANDMARK STATUS FOR THE STRUCTURE <br />AND REAL PROPERTY KNOWN AS THE RUSHTON APARTMENTS AND <br />LOCATED AT 501 WEST WASHINGTON, IN THE CITY OF SOUTH BEND, <br />INDIANA <br />STATEMENT OF PURPOSE AND INTENT <br />In 2005, Historic Landmarks Foundation of Indiana ("H L F I") was named <br />Receiver of the Building and Site known as the Rushton Apartments, located at 501 West <br />Washington, in the City of South Bend, Indiana, (the "Property" or the "Rushton") and <br />have petitioned the Historic Preservation Commission of South Bend and St. Joseph <br />County (the "Commission") to have the Property designated as a Historic Landmark <br />pursuant to South Bend City Ordinance No. 5565-73, as amended. <br />~'he Property is located within the West Washington National Register District <br />and is recognized in the Indiana Historic Sites and Stnictures Inventory of South Bend <br />with a rating of "Notable" meaning that the property is above average and that further <br />research may reveal that the Property is eligible for National Register listing and is a <br />contributing building to the West Washington National Register District. <br />The staff of the Commission has prepared a report and recommendation for the <br />Commission, which has reviewed the petition of H L F I and the report prepared by the <br />staff and has heard and discussed the recommendation of the staff for the designation of <br />the Property as a Historic Landmark. <br />Based on the Commission's Local Landmark Criteria adopted by the Common <br />Counci±, the Property meets three of the criteria for Local Landmark Status: <br />I) Its embodiment of elements of architectural design, detail, material or <br />craftsmanship which represent an architectural characteristic or innovation; <br />The Rushton is an excellent example of aturn-of-the-century Neo-Classical <br />design and retains a high level of architectural integrity. At the time of its <br />construction it was an innovated residential concept found in other cities but <br />not yet in South Bend. It was one of South Bend's first "high rise" apartment <br />
