RESOLUTION NO. 434-74 <br /> A RESOLUTION OF THE COMMON COUNCIL OF THE <br /> CITY OF SOUTH BEND REQUESTING THAT THE STATE <br /> OF INDIANA ENACT LEGISLATION WHEREBY THE <br /> STATE OF INDIANA WOULD COMPLETELY FUND POLICE <br /> AND FIRE PENSIONS. <br /> WHEREAS , the City of South Bend, Indiana, is a second <br /> class city and has been mandated by statute to provide certain pension <br /> benefits for police and firemen of said city. <br /> WHEREAS , the pension act requires that the city shall <br /> pay the excess of the estimated expenditures over the estimated <br /> receipts in said pension fund. It has been the experience of the <br /> police and fire pension trustees that the expenditures always exceed <br /> the receipts in said fund, and it has been required by statute that <br /> a tax levy be enacted to fund the police and fire pension fund. <br /> WHEREAS, the Common Council of the City of South Bend <br /> strongly feels that, since the State of Indiana requires by statute <br /> that cities shall pay said pensions and do their own funding, the <br /> State of Indiana should enact legislation whereby the state would <br /> completely fund said police and fire pensions to relieve the burden <br /> upon the local taxpayers since said burden is a result of a mandate <br /> by the State of Indiana. <br /> NOW, THEREFORE, BE IT RESOLVED by the Common Council of <br /> the City of South Bend, Indiana, that: <br /> SECTION I . The State of Indiana enact legislation to <br /> provide that police and fire pension funds be completely funded by <br /> the State of Indiana. <br /> SECTION II . This Resolution shall be in full force and <br /> effect from and after its adoption by the Common Council and approval <br /> by the Mayor. <br /> 12 7 <br /> Member of the /o on Co nci.l <br /> Adopted July 22, 1974 , as amended. <br />
