Bill No. 10 509 - j'1 <br />Ordinance No. 11 -17 <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, AMENDING CHAPTER 2, ARTICLE 5, SECTION 2 -52 OF THE SOUTH <br />BEND MUNICIPAL CODE TO INCLUDE ADDITIONAL FACILITIES TO BE <br />OPERATED, MAINTAINED AND MANAGED BY THE SOUTH BEND CIVIC <br />CENTER BOARD OF MANAGERS <br />STATEMENT OF PURPOSE AND INTENT <br />Indiana law at Ind. Code § 36- 10 -10, and more particularly §36- 10- 10 -29, specifically <br />grants to the city of South Bend, Indiana, the authority to create a nine - member Board of <br />managers to operate, maintain, and manage its civic center, which is known as the Century <br />Center. That authority extends to "any other public facility owned or leased by the city or by an <br />agency of it" IC §36- 10- 10 -29(a) (2). Pursuant to that statute, the City of South Bend <br />designated the South Bend Civic Center Board of Managers to manage, operate, and maintain <br />"Century Center and its programs." (South Bend Municipal Code, Chapter 2, Article 5, Section <br />2 -52). As identified at IC 36- 10 -2 -5, city facilities include "neighborhood centers, community <br />centers, civic centers, convention centers, auditoriums, arenas and stadiums." At this time the <br />general management authority of the Civic Center Board of Managers should be expanded to <br />include the facilities of the Morris Performing Arts Center and the Palais Royale. <br />As downtown South Bend continues to grow as an entertainment and convention center <br />with increased hotel and tourist options, and with local population growth, and more restaurant/ <br />entertainment facilities, the success of the City's Century Center, Morris Performing Arts Center, <br />and Palais Royale become increasingly intertwined. Uniting these entities under one <br />management board with the goal of maximizing overall benefit will improve the ability of each <br />entity to thrive. This ordinance is a critical step toward that goal and is in the best interest of the <br />City of South Bend and its citizens. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF <br />THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: <br />SECTION I. Chapter 2, Article 5, Section 2 -52 of the South Bend Municipal Code is amended <br />to read in its entirety as follows: <br />The South Bend Civic Center Board of Managers, a board of <br />managers for the purpose of supervising, managing, operating, and <br />maintaining Century Center, the Morris Performing Arts Center, the <br />Palais Royale and it-, their programs, is hereby continued pursuant to IC <br />36- 10 -2 -5. <br />
