ORDINANCE NO. JQ,- DS — )'I <br />AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY: <br />The portion of W. Monroe Street that lies approximately 179 feet <br />west of S. Lafayette Blvd. <br />STATEMENT OF PURPOSE AND INTENT <br />Pursuant to Indiana Code Section 36- 7 -3 -12, the Common Council is charged with the <br />authority to hear all petitions to vacate public ways or public places within the City. <br />The following Ordinance vacates the above described public property. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY <br />OF SOUTH BEND, INDIANA, as follows: <br />SECTION I. The Common Council of the City of South Bend having held a Public <br />Hearing on the petition to vacate the following property: <br />A part of the Southwest Quarter of Section 12, Township 37 North, Range 2, East, City of <br />South Bend, Portage Township, St. Joseph County, Indiana, and described as follows: <br />Beginning at the southeast corner of Lot 3 of the Coveleski park Minor Subdivision, the plat of <br />which is recorded in Instrument No. 1503430, in the Office of the Recorder of St. Joseph <br />County, Indiana, thence South 0 degrees 56 minutes 17 seconds East 82.50 feet to the <br />northeast corner of Lot 4 in said Subdivision and being on the south right -of -way line of <br />Monroe Street; thence South 89 degrees 13 minutes 50 seconds West 178.75 feet along the <br />south right -of -way line of Monroe Street to the southwest corner of the Monroe Street right -of- <br />way and being on the east line of Lot 1 in said Subdivision; thence North 0 degrees 59 <br />minutes 56 seconds West 82.50 feet along the east line of said Lot 1 to the northwest corner <br />of the Monroe Street right -of -way; thence North 89 degrees 13 minutes 50 seconds East <br />along the north right -of -way line of Monroe Street 178.84 feet to the point of beginning and <br />containing 14,750 square feet, more or less. <br />hereby determines that it is desirable to vacate said property. <br />Updated 6/22/12 6 <br />
