ORDINANCE NO. JQ,- DS — )'I AN ORDINANCE TO VACATE THE FOLLOWING DESCRIBED PROPERTY: The portion of W. Monroe Street that lies approximately 179 feet west of S. Lafayette Blvd. STATEMENT OF PURPOSE AND INTENT Pursuant to Indiana Code Section 36- 7 -3 -12, the Common Council is charged with the authority to hear all petitions to vacate public ways or public places within the City. The following Ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The Common Council of the City of South Bend having held a Public Hearing on the petition to vacate the following property: A part of the Southwest Quarter of Section 12, Township 37 North, Range 2, East, City of South Bend, Portage Township, St. Joseph County, Indiana, and described as follows: Beginning at the southeast corner of Lot 3 of the Coveleski park Minor Subdivision, the plat of which is recorded in Instrument No. 1503430, in the Office of the Recorder of St. Joseph County, Indiana, thence South 0 degrees 56 minutes 17 seconds East 82.50 feet to the northeast corner of Lot 4 in said Subdivision and being on the south right -of -way line of Monroe Street; thence South 89 degrees 13 minutes 50 seconds West 178.75 feet along the south right -of -way line of Monroe Street to the southwest corner of the Monroe Street right -of- way and being on the east line of Lot 1 in said Subdivision; thence North 0 degrees 59 minutes 56 seconds West 82.50 feet along the east line of said Lot 1 to the northwest corner of the Monroe Street right -of -way; thence North 89 degrees 13 minutes 50 seconds East along the north right -of -way line of Monroe Street 178.84 feet to the point of beginning and containing 14,750 square feet, more or less. hereby determines that it is desirable to vacate said property.
