b. Maintenance of Traffic <br />1) The Engineer shall prepare Maintenance of Traffic plans for the proposed <br />construction activities. <br />c. Permitting <br />1) The Engineer shall prepare and submit the application and back-up documentation <br />for the following permits: <br />a) MEM — Construction Permit for a Water Pollution Control Facility <br />2) The Engineer shall monitor the approval process and provide any additional <br />information that may be required to secure permit(s). <br />3) Permit application fees will be paid by the Owner and are not included in the <br />engineering fee. <br />d. Right -of -Way Engineering and Land Acquisition (Parallel Take) <br />1) The Engineer shall provide the services of qualified professionals to perform Right <br />of Way Engineering and Acquisition Services including title abstracting, right-of- <br />way engineering, appraisal, negotiation, acquisition coordination, closing, and <br />recording services for two (2) parcels of perpetual/temporary parallel take easements <br />to be acquired as part of the Project. <br />2) The Engineer shall engage a Subconsultant to provide preliminary title abstracting <br />for the parcels from which right of way is to be acquired. Title abstracting shall also <br />include a supplemental title update following acquisition of right of way for <br />verification of title information prior to submitting the secured parcels to the City of <br />South Bend for processing of payment. <br />3) The Engineer shall prepare right-of-way engineering documents to include legal <br />description and plat for the proposed parcel to be acquired. <br />4) The Engineer shall engage Subconsultant(s) and/or Engineer staff to prepare and <br />provide two (2) appraisals for the parcels to be acquired. <br />5) The Engineer shall provide negotiation, acquisition coordination and closing <br />services including the following activities: <br />a) Provide completed appraisals for review and authorization by the Owner prior to <br />initiation of negotiation activities. <br />b) The Engineer shall prepare preliminary offer and conveyance documents and <br />submit to the Owner's designated representative for review and approval prior to <br />commencing negotiations with the property Owner. <br />c) Upon review and approval of preliminary offer and conveyance documents by <br />the Owner's designated representative and/or the Owner's legal staff, the <br />Engineer shall commence negotiation activities with the property Owner. <br />d) Negotiation activities shall include presentation of the offer in person or by mail, <br />discussion of the project, explanation of right of way acquisition and eminent <br />domain procedures, preparation of Owner appraisal letter, pay voucher, sales <br />Page 5 <br />(Exhibit A — Engineer's Services) <br />EJCDC E-500 Agreement Between Owner and Engineer for Professional Services <br />Copyright © 2008 National Society of Professional Engineers for EJCDC.
