RESOLUTION NO. �'J�/i7.2 <br />A RESOLUTION OF THE COMMON COUNCIL <br />OF THE CITY OF SOUTH BEND, INDIANA, <br />TO ACQUIRE CERTAIN UTILITIES. <br />WHEREAS, the Common Council of the City of South Bend, <br />Indiana, finds that it is in the best interests of the city to <br />acquire the water and sewage disposal facilities of Clay <br />Utilities, Inc., and the wells and land heretofore purchased <br />by Clay Utilities, Inc. from Aqua, Inc. at the price herein <br />stated. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council <br />of the City of South Bend, Indiana, that: <br />SECTION 1. The City of South Bend shall acquire by <br />outright purchase or by lease - purchase in the manner deemed most <br />expedient the water and sewage disposal facilities of Clay <br />Utilities, Inc. in use or useful in the rendering of water and <br />sewage utility services in German and Clay Townships in St. Joseph <br />County, Indiana, and the wells and land heretofore purchased by <br />Clay Utilities, Inc. from Aqua, Inc., together with additions, <br />improvements, appurtenances and booster station at a total price <br />of Two Million Dollars ($2,000,000.00), and that the city proceed <br />forthwith to take such steps as are deemed necessary and appro- <br />priate to so accomplish acquisition of such facilities by purchase <br />or by lease. <br />SECTION 2. This resolution shall be in full force and <br />effect from and after its adoption by the Common Council and <br />approval by the Mayor. <br />PRESENTED Y-- 9'7 <br />NOT.
