The vacation would not hinder <br />the use of a public right of way by the neighborhood in which it is located or to which it is contiguous. <br />Engineering; Area Plan, and Community Investment stated the vacation would make access to the lands <br />of the aggrieved person by means ofpublic way difficult or inconvenient and the vacation would hinder <br />the public's access to a church,.school or other public building or place, both violations of Indiana Statute. <br />Therefore, the Board of Public Works submitted a favorable recommendation for the vacation of this <br />street subject to completion of a signed and recorded permanent access agreement between the owner <br />of the Zion Missionary Baptist Church, Inc. and the South Bend Cubs received prior to submittal of the <br />application for vacation to the Common Council. A copy of the signed and recorded document shall be <br />provided to the Board of Public Works. <br />Please contact Donna Hanson at (574) 235 -9254 prior to nicking up your radius map You will need <br />a radius map showing properties within 150' of the proposed vacation for your petition to the Common <br />Council.
