UBS <br />TM <br />March 21, 2017 <br />Common Council <br />City of South Bend <br />Room 455 County -City Building <br />South Bend, IN 46601 <br />Re: Vacation Petition - Monroe Street Vacation <br />To the Common Council, <br />Heading for Home, LLC. / South Bend Cubs wishes to vacate the following described alley to <br />accommodate future development for apartment units as part of the Berlin Place Mixed use project <br />adjacent to Four Winds Field: A part of the Southwest Quarter of Section 12, Township 37 North, <br />Range 2, East, City of South Bend, Portage Township, St. Joseph County, Indiana, and described as <br />follows: Beginning at the southeast corner of Lot 3 of the Coveleski park Minor Subdivision, the plat <br />of which is recorded in Instrument No. 1503430, in the Office of the Recorder of St. Joseph County, <br />Indiana; thence South 0 degrees 56 minutes 17 seconds East 82.50 feet to the northeast corner of Lot <br />4 in said Subdivision and being on the south right -of -way line of Monroe Street; thence South 89 <br />degrees 13 minutes 50 seconds West 178.75 feet along the south right -of -way line of Monroe Street to <br />the southwest corner of the Monroe Street right -of -way and being on the east line of Lot 1 in said <br />Subdivision; thence North 0 degrees 59 minutes 56 seconds West 82.50 feet along the east line of said <br />Lot 1 to the northwest corner of the Monroe Street right -of -way; thence North 89 degrees 13 minutes <br />50 seconds East along the north right -of -way line of Monroe Street 178.84 feet to the point of <br />beginning and containing 14,750 square feet, more or less. <br />The approval of this vacation shall not be injurious to the use of other property in the immediate <br />vicinity. It shall not be detrimental to or endanger the public health, safety, morals, or general <br />welfare.
