INDIANA 46601-1830 <br />CITY OF SOUTH BEND PETE BUTTIGIEG, MAYOR <br />BOARD OF PUBLIC WORKS <br />March 14, 2017 <br />Francis Linarello <br />327 W Marion St. <br />South Bend, IN 46601 <br />PHONE 574/235-9251 <br />FAX 574/235-9171 <br />RE: Alley Vacation — First North/South Alley East of Portage Avenue from Navarre Street to <br />Marion Street (Preliminary Review) <br />Dear Mr. Linarello: <br />The Board of Public Works, at its March 14, 2017, meeting, reviewed comments by the Engineering <br />Division, Area Plan Commission, Community Investment, Fire Department, Police Department, and the <br />Solid Waste Division. The following comments and recommendations were submitted: <br />Community Investment and the Engineering Department state the vacation would violate I.C. 36-7-3-13, <br />making access to the lands of the aggrieved person by means of public way difficult or inconvenient. They <br />noted a garage at 334 Navarre St. would become land -locked and at 330 Navarre St. would be <br />compromised (Welsheimer's Funeral Home). The Fire Dept. gives an unfavorable recommendation <br />due to excess distance from hydrants <br />Therefore, the Board of Public Works submitted an unfavorable recommendation for the vacation of this <br />alley and recommended the petitioner submit a request with an access agreement entered into by the three <br />parties. <br />Please contact Donna Hanson at (574) 235-9254 prior to picking up your radius man. You will need <br />a radius map showing properties within 150' of the proposed vacation for your petition to the Common <br />Council.
